robinson way letters

Hello, we have a tesco cc that has not been paid for approx 5 years.
this has been passed onto robinson way, after several phone calls and letters that we dont answer. They have now sent a letter saying it will be passed onto thier solicitors.

Do we carry on ignoring it or will they issue a ccj.
we own (mortgage) our house.

    they might or might not. hard so say

    if they do then the http://www.legalbeagles.info/forums is good place for advice on defending a claim from a debt collector

    If you're in Scotland and you haven't paid for five years, they are out of time to take court action.

    In England/Wales it's six years.

    Have RW actually bought the account? Or are they still referring to Tesco as their 'client'?

    yes. HPH is Hoist Portfolio Holdings a debt buyer which is part of same group of companies as robbers way

    Yes, I see a few court claims from them but by no means do they always take court action.

    You could try to wait it out, or try a full & final settlement offer. If you do the latter, be sure to use the National Debtline template as it is headed WITHOUT PREJUDICE and therefore cannot be used as evidence of acknowledgement in a court claim.

    You could also send them the Prove It letter first, asking for documentary evidence that the debt is yours and for a copy of the CCA. Make sure the sum they are asking for and the terms are correct before you do anything that acknowledges the debt. Do everything in writing and note in the letter that you will not accept calls or visits from them, and insist that they also only communicate in writing. That stops a lot of the pestering.
    Some days, it's just not worth chewing through the leather straps....

    Can I ask how long it has been since Robinson Way purchased your debt ?

    I have had a letter from them this week saying they have bought an old Nationwide cc debt of mine. This debt will become statute barred on 1st August this year and I was hoping to be able to keep my head down until then but phone calls have started today.:(
