Vodafone Credit File - Has cost me my job

Hi folks,

Hoping for some help or advise.

I work in Financial Services - Self Employed - and my employer due to the nature of the business requires that I must have an impeccable and clean credit rating, something which I signed up to and agreed with.

Now, in December 2015, I ended a contract with Vodafone, long term complaint which they cancelled my contract, and wrote a letter to me confirming this and that no fee's were outstanding. I still kept my DD active another 6 weeks just incase.

2 1/2 weeks ago, upon agreeing to a new contract with work - they undertake financial and credit checks monthly - it was found that Vodafone had passed unpaid bills over to Credit Referencing Agencies stating there was unpaid amount. Three months of insurance it appears, which I have found out was added to a dormant account with no number after the accounts were closed, and Vodafone have admitted via email this was done fraudulently.

Now, as soon as I was made aware of this, I knew it was a mistake and advised my employer - they gave me a few days to resolve (just required an email from VF that it was a mistake and they would resolve). Otherwise I would have my contract suspended until resolution. This was until Friday 15th April.

They initially refused to look in to it, they then agreed they had made this error and would have the records reversed. I asked for an email - they said no... It has been escalated to their Directors Office, and today after 2 weeks I finally received the email.

My issue is that because of their fraudulent admittance and hesitancy to do their job and resolve, I have now been unable to work ad have lost out on 2 weeks pay. I completely understand my companies stance on this. Vodafone have admitted liability and have tried to fob me off with £50 for those two weeks. I have lost out substantially more, and decided to take it to deadlock and to the Ombudsman. At this point they then offered £150, and I again refused.

They are citing they do not cover for loss of earnings - how can this be, when these fee's were added fraudulently, they have admitted liability that it should not have occurred and agree they have made a mess of trying to resolve.

I am fortunately able to go back to work on Tuesday, but does anyone know if i have a leg to stand on here by claiming for my full loss?

    A little confused. Are you self-employed or do you have an employer?

    With conclusive proof you could try the legal route but be prepared for a battle here and there is no guarantee you would win, They could also claim costs from you should you lose.

    Sometimes in life it is far easier to move on with things and if you believe that you were wronged chalking it down to experience and accepting what was offered may be the better call.

    It wasn't likely to be 'fraudulent', probably more likely an admin error - then compounded, probably, by well meaning attempts to pacify you. Are you sure the email said it was fraud? Using that exact descriptor?

    Your complaint will be taken more seriously if you just stick to the facts and outline the consequences to you of their error.

    Over-egging the pudding by accusing them of fraud is just undermining the merits of your complaint.

    You might want to consider referring this to the Financial press the Daily Wail is campaigning against them at the moment.

    I am self employed in the sense, they have a contract with my company, where I am the employee undertaking the tole.
    With conclusive proof you could try the legal route but be prepared for a battle here and there is no guarantee you would win, They could also claim costs from you should you lose.

    Sometimes in life it is far easier to move on with things and if you believe that you were wronged chalking it down to experience and accepting what was offered may be the better call.

    It is easy, and I am more than willing to take it down the legal route. I have a SAR request in and also informed Vodafone that when I was on with them I would be recording the calls - which I have for my own records.

    Yes, the email received from their Directors Office states 'Fraud' specifically.
  • Further update this morning - Vodafone have yet to take it to deadlock as agreed and have come back with a higher offer, and asked if they can have their Legal team contact me by COB to discuss further.
