CCJ Question

Just seeking some re-assurance. On the 20th April I received a telephone call from the owner of my past address to say they had received a letter for me that day. A "Judgement for claimant letter" and the judgement was dated the 15th April. The proprietor claimed that this was the first letter received for me which I know is absolute cattle deposits! I discovered that the judgement was for an overpayment on a previous job that I knew nothing about since I had been living 50 miles away at a different address for the past year ( I have registered my new address on the electoral role which is another thing that has riled me!!) Anyways.. I paid the amount on the judgement on the very day I was informed of it. The chaps acting on behalf of my old employees told me that as the payment was made in the 28 days after the date of judgement as soon as I receive the letter of confirmation from them all I need to do is forward this on to the court with a fee of £10 and ask for the judgement to be cancelled. I have in the meantime checked my Credit report and the judgement is already on there! I am really panicked and about this - Is this the norm? Should it already be registered prior to the 28 days?

    A judgment registration is only removed because it was:

    a) entered in error,

    b) paid before the court date,

    c) cancelled because full repayment was made within one calendar month of the judgment date

    If judgment was entered in error, application must be made to the court to have the judgment set aside for which a court fee of £155 is payable (payable to HMCTS). If granted the court should notify us to remove the judgment from the register.

    From 6th April 2006 when the court are provided with evidence that a judgment debt has been paid in full either before registration or within one calendar month of the judgment date the registration will be cancelled and removed from the register once we have been notified by the court.

    You may also apply in writing to the relevant court for a Certificate of Cancellation enclosing:

    a) evidence that the debt has been fully repaid with one calendar month of the date of the judgment

    b) a statement advising that reasonable steps have been taken to obtain such evidence but you have been unable to do so,

    c) a statement advising that you believe the evidence of payment within one calendar month of the date of judgment is already held at the court; and the court fee of £15 (cheque payable to HMCTS)

    As above, you'll need to get the court to cancel the registration of the CCJ.

    Strictly they should do this if it is simply brought to the attention with evidence that the debt was paid in full within one calendar month of the judgement date, but they may try to insist that you formally apply for a cancellation with the £15 fee. May noit be worth arguing too much.

    The court will update the registry trust, which then feeds on to the CRAs to update/remove etc. Takes a few weeks to filter through...

    Thank you both. The solicitors are dragging their feet with a confirmation letter but I telephoned the claims court today and was told that a screenshot from my bank statement should be sufficient as proof so I've emailed this to them.
    I'm supposed to be going to see a mortgage advisor later this week to buy the house I am currently renting so this has truly killed that.. The owner has gone into care and the family needs it sold asap to pay for it so we will probably have to move out now. Pity they can't remove an entry as quick as they put it on :(
