I seem to remember a couple of similar letters, after my bankruptcy, one of which was from HSBC - I was advised to ignore them (old BCSC thread) and not surprisingly nothing happened. I think it's their way of trying to get preferential treatment from the OR.
Looks as though it will be 'EGG on their face'.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • That clause is there to ensure that Egg are classed as being owed the full loan rather than simply any missed payments when it comes to dividing up the meagre assets of the bankrupt pro-rata between their creditors.

It's only effect is to claim that Egg are owed the lot at the point of bankruptcy, it does not and cannot override the bankruptcy itself, and they will lose in the county court if they try and sue you for this money.

As others have said, hand it to your OR who will explain to Egg exactly what they're getting from you and how they can legally go whistle for the rest.

I'm no big fan of Egg (understatement of the year:rolleyes:), but you've got to hope Moorcroft paid a lot for it. :o:D
