zzps letter

i have come home to a letter from zzps demanding I pay £200 for a fine issued in January 2015.

I appealed this this at the time through POPLA and didn't hear anything back so assumed it had gone away. I was very surprised to see this letter 15 months later!

I appealed on the grounds that I was in the gym at the time which allows me 2 hours free parking. I entered my registration number into the computer at the gym, and I even had e-mail evidence from the gym to prove I was in there and didn't outstay the 2 hours.

So does anyone have any advice as to what I do next? Just ignore the letter? Or reply with a robust letter?

I am assuming my POPLA appeal was refused and that if this goes to court, this could go against me. It just seems so unfair as I could prove I was in the gym for the whole time

    Did you use 'no GPEOL' in your POPLA appeal and was it stayed pending the Beavis case?

    If so then it's probably still stayed pending some daft decision by the POPLA pretender appointed by the BPA = Wright Hassall, who also happen to act as private parking 'debt collectors' and whose letters often follow ZZPS letters - yes really, THEY are deciding these cases!

    I would not assume so. If it was adjourned a year ago, they are ALL still adjourned but Wright Hassall wrote to the case appellants only last week about their POPLA appeals. Did you get anything like that last week? Check your emails and spam/junk folders - but it was a letter that people received, in fact.

    Did you ever get an evidence pack from the PPC at all during 2015, have you ever seen their POPLA evidence? Did you rebut it to POPLA?

    You could email the BPA and ask why your case has never been decided by POPLA. You can't email 'old POPLA' (2015 version) as they don't exist any more, so you'd have to ask the BPA what happened to your POPLA case and cite your PCN number & POPLA code and the name of the PPC:

    Nope, even if you lose at a hearing there is no CCJ nor effect on credit rating AT ALL if a defendant then pays the charge (which cannot have high costs added). So no big deal, more of a life experience! And cases can be defended.

    Who is the PPC? We can tell you if they are litigious or not.

    Finally, look, now is the time to complain to the Gym Manager and threaten to leave if you are still a member. Use your membership as leverage for a formal complaint and state that POPLA has been removed from consumers and cases are now being heard by a debt collector friend of 'PPC World' which cannot be right, is a clear conflict of interests and if you end up sued you will ask for the Gym themselves to be joined in the case to answer for their involvement in suing Gym members and to explain why it wasn't cancelled.

    Thanks for taking the time to spell all of that out clearly for me, it's so hard to make sense of all this, I literally feel like this is day light robbery and harassment!

    I will be contacting the gym and hope that they will be able to help, at the time they didn't offer to contact the parking company (which is Civil Enforcement) and so I'm hoping that this might have changed a year later, especially in light of the conflict of interest you describe. And if they can't help, I'll be fighting this all the way to court - seems like I won't be any worse off than I am now!

    Well done. That wasn't too painful.

    Do you have it in writing? Have you had it in writing from CEL? Just a word to the wise - it wouldn't be the first time that a PPC played dumb and ploughed on regardless.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • The gym manager says the fine has been cancelled and this should be confirmed in writing, so a letter is on it's way to me.

    From the e-mail exchange I've had it seems that this happens a lot at this particular gym, so fingers crossed this is the end of it.
