Advice Please

Hi,

I need some advice please. Basically I have had an IVA previously which began in 2006, sadly this failed, so my creditors are now free to chase me again. The IVA was with Blair Endersby which was taken over by Grant Thornton, I don’t remember agreeing to that but anyhow.

I had a letter saying that the IVA had failed on May 2014

I had been getting letters from Max Recovery who had obviously bought up the majority of my debts. these letter have been coming through yearly. This year they arrived at my parents address for some reason. My parents have now received a letter from Dryden Fairfax (dated 17.03.16 but only received recently) stating that they are chasing on Max recoveries behalf. The total debt is chased is £9,500.00.

My question is how to I know this is genuine, should I send a CCA request?

Should I ignore the letters, I don’t really want them to keep going to my parents house though. Or should I contact Dryden Fairfax and offer a payment?

    Unfortunately you are back to square one now, the legal protection you enjoyed under your IVA is no more.

    Your creditors can now take whatever action they deem nessessary to recover what's owed.
    CCA is a good way to start, write and tell your creditors to converse with you at your address only, and not your parents.

    Any other formal option suitable for you ? DRO for instance ?

    I assume that you don't mean to say that your creditors have written to your parents directly - rather that the correspondence is still in your name but going to their address.


    At face value I see no reason to doubt that Dryden Fairfax's involvement is genuine. Theirs is a common name we see crop up in debt correspondence, but by all means make CCA requests if you want to be clear on what is owed and to whom.


    I don't know that ignoring the letters will do you much good here; it's just likely to result in these debts lingering even longer and it's already (at least 10 years) since you first tried to resolve them. Perhaps, as sourcrates suggests, a Debt Relief Order may offer you some closure within 12 months (subject to eligibility), but it's worth taking a look at this summary of your options:

    Just continuing on from this. I sent a CCA request and they replied a few weeks later. They have sent me a reconstituted agreement, it won't let me attach the photos.

    There are quite a few pages but most are just blank terms and condition pages so I haven't attached those. My question is, is that sufficient. As it's not clear to me how one signed agreement, constitutes the four debts they are chasing payments for.

    Would you recommend my next step being arranging a payment plan / dro ? I'm a bit hesitant as they don't show up on my credit report. Or do you think I have a right to ask for more detail.

    I want to be sure if I do pay I am paying the right people.
