Warrant of Possession

I wonder if anyone can advise please? The mortgage company have instructed a solicitor who has applied to the court for a Warrant of Possession. My husband was effectively made redundant in January, is currently trying to find a job, and as a result we're 3 months behind on our mortgage.

Is there anything we can do to postpone or delay this, until my husband finds employment? I'm petrified that we will be made homeless.

    Really you should post on the housing board. Much less traffic here on the bankruptcy board.

    that said:
    1, communicate with the lender.
    2, prioritise the mortgage ahead of credit cards and non priority debts
    3, seek help from family.

    Just on here (without revealing any identifying / personal stuff) and also I can provide you an email address for documents etc - I'll provide that by Personal Message (PM) on here.


    A few questions:
    Are you eligible / does the Breathing Space Loan scheme operate in your area?
    How much equity in the property?
    What are the normal contractual payments?
    How much arrears do you owe?
    How long has the mortgage got left to run?
    Who's name is the mortgage in?
    Are there any children living in the property?
    I note that your husband has now found a job - can the contractual payment now be afforded, or if not how much can be afforded?
    How old are the owners / mortgage payers?
    Who is the mortgage company?
    Send some of that in a PM if you want to.

    Has there already been a court hearing, or is their solicitor making an application to court for the first possession hearing?
    If there has already been a possession hearing - did you attend / what happened?

    Not aware of a Breathing Space Scheme, but will try & find out. Do we just ring our local council?
    There are 3 children living in the house.
    My husband is self employed, but it's 100% commission sales (& not a quick selling product), so he is looking for employed positions to give us regular income. He's not got one yet.
    They have on 7th April, applied for a warrant of possession, so as far as I'm aware there hasn't been a court hearing.

    From working with this family and gaining some more income from work and benefits, the lender has agreed to withdraw the warrant to evict and settle for an affordable offer.
