new starter references

Hi all,

i left my last company a few months after a fallout with my boss, leaving with a final written warning. before that we got along well and just had a day from hell.

im just worried the final written will appear on the reference and cause issues (im trying to start a new here)...

also they are asking about convictions. i have a spent conviction and states you do not need to disclose spent but after that states they want evidence of spent convictions? do i need to disclose? im not sure what DBS check they will do so thinking about just being up front about it all.

what do you think is best?

Forget about the reference from this company and use someone else as your reference. Maybe a previous employer or someone from your school. I wouldn't even mention you ever worked for this company.

Depending in job depends on whether you "need" to declare all convictions or not. I wouldn't declare any spent convictions. If they are spent they are highly likely to be minor convictions so you would have little to worry about.

if you choose not to use the previous employer as a reference and dont mention them then it will look like you have a gap in your employment history wouldn't it?

I was going to say that a personal issue between you and your boss shouldnt mean you have a bad reference as its a matter of your quality of work and attendance etc but you say FINAL warning so its not like its the first time, not sure what to say regarding that tbh.

Unless it is a job where you are required by law to disclose spent convictions then this is one of those strange situations where you are legally allowed to lie!

If the employer were to find out it would be unlawful for them to take any action against you or discriminate in any way.

Obviously proving that was the reason you were not appointed (or appointed then later dismissed) may not be easy but the employer would be taking quite a risk.

the reasoning for the final written was due to the situation - i shouted at my boss in a meeting room where others may have heard -loss of confidence in me...i felt awful about the whole situation.

i do realise it was my fault, it just seems impossible to start a fresh even when you have learnt the hard way from your actions.
