Possible case for discrimination?

Hi,
Brief outline...promotions have come up at work, myself and others applied. I've only been permanent with the company for one month. My manager says that I should get the job but today I've been turned down and a complete outsider (who has been permanent for longer) has got it.

Is this discrimination?

    Well, by definition in choosing one person for the job they have to discriminate. As to whether it's unfair, I think probably not.

    What type of discrimination are you thinking of? Sex, age, colour, sexual orientation?

  • As you said even though the other person is an outsider they have been permanent for longer.

    stick with it but dont fall for carrot dangling either,

    ask about future promotion chances / options.

    You sound like my daughter. OF COURSE ITS NOT DISCRIMINATION. They have more experience than you.

  • Maybe they have more experience because they have been there longer, that doesn't necesserally mean they are better at the position or suitably qualified. My argument is that if I am better qualified for the job but they give it to someone else who isn't as qualified just because they've been there longer, is that wrong?

    You originally described the successful candidate as a "complete outsider". Presumably they were not considered likely to "win" the job until they were able to present themselves during the recruitment process.

    That presentation seems to have impressed the recruiters that they were qualified. Unless you were involved as a selector, how do you know that you are "better qualified"? In what way do you think you are better qualified? Have you considered all the requirements of the position? Maybe on balance the other person has better experience and skills as a total package they can offer the employer.

    If you are good, your time will come.

    Your manager is one person on the selection committee and most selection committees are democratic in one shape or form. Some have one person with the final say after the committee has rejected most candidates on their selection criteria.

    Secondly the person who went for the job may have been "advised" to go for it during their yearly appraisal otherwise it would indicate to the company that they shouldn't be working there at all.

    From your posts you sound quite young so I suggest you wait until you are the company longer to work out how to deal with the politics in the company and whether you are likely to get a promotion in the future. Also as you sound female unfortunately you are likely to find out in the future what it is to be truly discriminated against particularly if you have children.
    I'm not cynical I'm realistic :p
