CMS and BIK

First of all, let me state for the record that I have always taken my obligations to pay child maintenance seriously.

Now, I have an issue with the way CMS calculate child maintenance.

I am full to me employed, on a salary and have a company car so have a BIK tax obligation.

In working out my earnings, the CSM have taken my gross as from my P60 and added the company car benefit to reach my total gross earnings.

My problem with this is that the car benefit is not actually earnings, but a tool HMRC use to calculate how much tax I need to pay.

My argument to this is that if I applied for a mortgage and included the the car benefit as earnings, this wouldn't be accepted.

Has anyone else come across this or found a solution as the CSM and HMRC are just blaming each other and not giving me a straight answer as to why they do this and how they can justify it?

    The whole welfare system is full of little things like this. Every department calculates stuff that is 100% in their interests only.

    Example:
    when i first started paying CSA i had just moved back to my mums. She was on housing benefit at the time. The housing benefit said i could support her so entirely cut her HB to 0. CSA said because she was my mum (and it was her name on the rent etc) i wasnt entitled to claim anything against housing costs.

    Nothing you can do about it. Its just the way it is.
