Northern Rock taking me to court!!

Hi. I am having a problem with Northern Rock.

11 months ago my wife and I had our first child. Great!
My wife then went on maternity and was only entitled to statutory maternity pay. Not so great!

During this time we were unable to meet all our financial obligations and so after reading up on this site and national debt line as well as others i contacted my creditors and made an agreement of £1 per month for six months. all payments were made. At the end of the agreement i asked for and was granted a further month and then started back with the payments.

At this point i was still struggling and thankfully my parents stepped in and paid off my two lowest loans.

This left one debt! Northern Rock and a sum of £17000.

Ever since the end of the agreement i have paid the full monthly amount to Northern Rock. However the first payment was a little late as i tried to explain to them it would be.

Despite full monthly payments they have now decided to take me to court as i can not pay back the sum of £2700. (the money i didn't pay whilst i was in the agreement)

I don't know what to do. It is impossible to find that kind of money (and now they want the full amount)

I am now able to pay the loan but as one lady from Northern Rock explained

'we want security against your house so that you will not be able to do this again'

I have just received the court papers and do not know what to do

Are they in the right or wrong?

Please HELP!

    Are they applying for a charging order?

    Hi there, I have several posts on at the moment re Northern Rock and Charging Orders, they are having a campaign as they themselves are in financial difficulty!!! They will try and take action to place a Charging Order on the property. Speak to CAB they have been very helpful and are in the process of trying to make reforms to the current Bill going through Parliament that will make it even easier for the likes of Northern Rock to do this un-necessarily. Try searching Charging Orders or Northern Rock on the Debt Free Wannabee forum for more information.

    Northen Rock's solicitors have sent me a county court claim form saying that despite their efforts i have failed to pay £2459.88. ( even though they agreed to £1 per month

    Make sure you respond to the claim form in time. Complete the admission form if you agree to the amount they claim and ensure the form is completed in as much detail as possible. You can make an offer of payment on the admission form. Once a judgment is made ensure you stick to the terms. If the terms seem unreasonable (amount you have to pay etc) then you can request redetermination within 16 days.

    If you disagree with their claim you need to complete the defence instead.

    Its not that i disagree with the amount of the loan but i disagree with the way they accepted the offer of £1 per month and then said they wanted all of the £2459.88 payed back immediately.
    If i had the money to do that i wouldn't have had to go down to £1 per month in the first place!

    Would i be able to defend the case on that argument or can i only defend if i disagree with the amount?
