    Hello.

Yesterday and this morning i have checked my credit file with Noodle, Experian and Equifax and there is no sign of this debt on any of the companies for Arrow or Restons or any other firms with that amount owing.
There are only 2 defaults on my file, one for a credit card that has been partly settled and one for my IF bank that was also settled.
As for Restons saying i made a payment in August 2010 on my credit file the IF account has a default date of November 1st 2010 and the 5 months previous to that from June 2010 shows that the account had 3 or more missed payments on the account so i dont think it came from that account.
I did have a Barclaycard at that time and they reduced my limit to about £50 over my balance of about £350 i think due to them being scared i did a runner. I kept up with all the payments on that card and still have it today with a limit of £2000 and they keep wanting to put it up but i said no.
Tomorrow is their deadline for me to respond to the letter and looking through some of the threads on here there seems to be a few about Restons and offering hugr discounts to settle before court but no mention of a % they will offer but i suppose it is to make you contact them.

If you are looking to find out if ou paid them from your IF bank you could send a SAR and £10 to them to see what info they have left as far as statements go.

  • Hello.

This morning(11/08/2016) the postman delivered a letter from the Court Services for my CCJ action from Arrow/Restons. Opening up was a shock and left me shaking like a leaf.
I got my stat reports from Euifax and experian last week and none of them show me owing money to MBNA,Arrow or any defaults for that amount.
I have used noodle for over a year and there has never been a default showing either from last year but then maybe they did not report to any of the credit ref agencies.
On the Equifax online report it showed the IF bank default as 02/11/10 but looking back to June 2010 it reports me as having at least 3 missed payments and the balance owing is the same for the next 5 months upto the default date. I managed to get my opening statements from Natwest fo 2010 and there were no payments made to anydody i owed money that year.
I am not sure what to do now. Is it still possible to make an offer to Arrow of less than £1000 on a £5000 debt as i am now out of work and the money is what my dad said he will give me.
Thanks for all the help you may give me.

    Hi,

I've told you before, it's them that have to prove a payment was made, you don't have to prove anything, stop going off on a tangent and worrying about irrelivant things.

Stick to what does matter, what does the letter say ?

  • Thank you sourcrates.

It was a claim form from CCBS Northampton from Arrow Global and their solicitors Restons about the outstanding debt and to pay all, make payments or defend the claim in court.

    Ok,

So you have now received a court claim yes ?

Strongly Suggest you post on :

    http://legalbeagles.info/forums/forumdisplay.php?105-Received-a-Court-Claim

They will tell you exactly what you must do to defend this, don't forget to acknowledge service online, that should give you 28 days to respond.
Don't panic, this is very common with statute barred debts.

It's difficult to predict which route might work best for you:

    ignore
    send a prove-it
    send a SB letter
    make an offer

My feeling is if they feel they can get a claim in before a date they can say the SB clock would have expired, then they will do that, regardless of what you do.

You would then be advised to let legalbeagles help you to defend.

Sorry to be proved right on that.

Sourcrates advice and link is where you need to go now
  • Good morning.
    Quick update.

I went to leagalbeagles and got some great help.
I sent off a CRP to Restons and a CCA to Arrow by signed for method.
Got reply from Restons saying i have everything i need in the court forms and they will not give me any other details i requested in the CRP request which looking on here/LB's site is pretty much the standard response from them.
CCA reuest was posted to Arrow Guernsey address as shown on the court for. As of today the letter has not beed signed for and digging deeper it seems Arrow do not live at that address and moved. L/B's have told me that i have done right sending it to the address on the form and as the solicitors have/may given the wrong address on the claim form i have done all i can to get the CCA and in court it would seem to the judge they do not have it or are witholding from me.
I also have been to MCOL and registered to say i got the form.
