    CMS can continue until the August after the 'child' reaches 19 in some cases depending on what sort of education they are doing.
  • well obviously he cant house her due to one bedroom property (very selfish), if your looking after the child then you get the child benefit regardless of what he says, you say you dont want to claim against his wishes, but hes doing nothing for you or his child, infact it seems like hes being quite aggressive, let him see you in court.

    Put in a claim for Child Benefit, Tax credits (if applicable) and maintenance. Your niece will flag up as being already on a claim so they'll do an assessment. Is she registered at school near you? Are you the primary contact? Does she go to the doctors practise near you? These are all things that will show who has primary care of the girl.
