Out Of The Blue

I received a letter from a debt collector stating that I owe money to them for a company that I have never heard of. On speaking to the company they are requesting that I send in a copy of my passport or drivers Licence with my signature on this. I have refused to do this.

The debt relates to a debt in the UK, where I lived over seven years ago.

As this is the first contact, July 2007, that I have had with them and I am not aware of any outstanding monies owed, I have requested them to send me a copy of the contract / agreement and if what the case that I owed money then we would discuss this. They have refused to do this.

Can anyone advise what course of action to take or if I have taken the wrong course of action, as I would consider the actions I taken to be reasonable but I find there attitude and communication not acceptable.

  • You need to send a CCA request for the original agreement. If they don't supply it, they can't enforce the debt.

    Search on here for CCA, and you should find a template letter. There is definitley one on the consumeractiongroup forums, and I'm pretty sure someone has posted one here.

    EDIT: If no correspondence has happened in 6 years I believe the debt can be written off anyway but you'd have to check this.

    We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.

    We understand a copy of our credit agreement should be supplied within 12 working days.

    We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    We look forward to hearing from you.

  • I have read that if the debt is more than 6 yrs old and you haven't acknowledged the debt in the last 6 yrs then it is statute barred and they can't enforce it. Have a look on some of the threads here for similar cases.

    I think the key is to not acknowledge the debt, however that doesn't stop from asking for a copy of the alleged contract. If they don't supply it then I'd suggest ignoring it.

    It's possible either the debt has been sold on (very cheaply) to this company, or they're just looking for people with the same name or surname to the person who held the original debt on the off chance someone will pay. They do that sometimes.
  • Please help- I have now has debt collectors at my door for some debt that I am not aware of. The debt collector Lowell Financial refuse to talk to me and provide me with any details even though I have sent them letters. They do not acknowledge receipt.

    This so called debt is more than seven years as it's been that length of time that I lived in the UK.

    send a letter recorded delivery and check on line for proof of posting. If they ignore that they can go whistle until they provide you with the requested CCA info. remember to enclose th £1 statutory fee.

    Tell callers at your door to get lost you are not obliged to deal with them any more than anyone else.

  • Don't send anything with your signature on to them... it'd be too easy for them to make up a CCA with your signature on and them say it's your debt..
