Less hours next week than contract says.

Starting this monday my supervisor has me down for 4 and a half hours under the stated amount I am contracted to do per week. I spoke to him and he said he doesn't have the hours available even though someone else on the staff with the same contracted hours as me has a whole 7 hours extra.He then stated that my hours are actually only an average and that he has no obligation to give me the amount stated on my contract. When I pressed him a little explaining that I knew my hours are specifically stated in the contract he fobbed me off and told me to call someone higher up claiming it was above his position to do anything, even though he is the one who actually does the rotas ( come to think of it I've never actually spoken to anyone in the company senior to him).

After my shift I looked out my offer of employment and my terms and conditions. Both specifically state that I do specific hours even though the hours have increased since then, no menttion of an average or the words "up to". Neither does the document I signed confirming the increased hours.
My supervisor is a good bloke but he's not the most enthusiastic of people when it comes to the job and I get the feeling he's trying to put me off doing anything. I plan on calling the manager above him on monday however just to complicate things we are moving to a different company via TUPE within the week so I doubt anything will happen?

Should I take this further with the current management or wait until the new company take over and potentially get off to a bad start with them? Also I've read that a job advert can have bearing on a job, I dont have a copy of that advert however if it stated my hours were an average would that supercede the contract?

    What he may mean is you'll still be paid your contracted hours, but make up the shortfall that you've not been able to do another week.
    We used to have this at my last place - if a shift was 7 hours it couldn't be split, so I'd have to give all 7 hours to one person even if someone else was 3 hours short. People on a 25 hour contract might do 23 hours one week and 29 the next - at the end of each month I'd then check the total hours and pay any overtime. It all works out the same in the end.

    I've worked for this company for just over a year. This has never been an issue before. I doubt it's what you are suggesting elsien, I believe there is a set number of hours in the contract with this site each week to be filled by the 6 of us according to the hours in our contracts. Shift lengths and days worked do change however the standard hours worked don't. The supervisor usually puts over time on the board for anyone to sign up for if he doesn't ask you specifically.
    The hours for myself and another co-worker went up to 25 a week as a third employee is starting another job so he cant fulfil his full time hours. My supervisor said it was because they didn't want the site to lose hours during in the TUPE process however all the paper work states that it's set hours per week.
    Since then both of us have had 25 hours or above. I'm really struggling to understand my supervisors attitude as I'm not asking for hours to be created for me, they are already budgeted for and on the rota. I just want what is stated in my contract.

    Just an update for those who'd like to know. I emailed the HR department and they tell me my hours are a set amount each week. Need to speak to my supervisor tomorrow but my TUPE interview is tomorrow too so hopefully get this issue sorted before the 1st when the new company takes over.
