How would you go about offering to pay the other debts at a reduced rate? s there a template for me to offer a % of total amount owed?

    Hi

You can use this sample letter to make a Full and Final Settlement offer.

    www.nationaldebtline.org/EW/sampleletters/Pages/Full-and-final-settlement-offers-%28sole-name%29.aspx

Make sure you get written confirmation that they accept your settlement offer before you make any final payments.

Am i right in thinking that the Sept 2009 and the Dec 2008 debts are statute Barred??

I then emailed them regarding the further more recent debts which came to around 1k in total offering to pay £250 as a final settlement this is all I have atm that is spare I am able to up it a little but not much to which they replied

    Good Afternoon,

    Further to my earlier email.

We would not look to combine all of your accounts into one amount as they are all individual debts. Any payments you are making must be done so respectively for each account. This is so we can accurately deduct any payments you are making from the outstanding balances. Please also be advised that Lowell are not obliged to offer a settlement and therefore, each of your outstanding balances are correct and owing.

Please advise how you would like to proceed with your accounts?

I look forward to hearing from you.

    Kind Regards,

    WHAT NOW?

    Dear Darren,

Please accept my apologies for a third email however, I have just received the below email from yourself.

I appreciate your comments in regards to this account and I can advise that I am now looking into this for you. I will contact you as soon as I have an outcome.

    Kind regards,

    Emily

Lol well what happens if i don't pay what can they do?

Dont get me wrong id pay if they took some form of settlement but it seems there not willing to play ball.

I assume these will drop of my file soon so settling in part or full will have no positive affect and not paying wont affect the credit either because they cant do nothing right?

They could take legal action over the enforcable accounts, then again, you might not hear from them again.

It's your call how you want to play it.

  • Ok so a quick update from Lowell:

    Dear Darren,

    Thank you for your email.

Lowell Reference – 172488058 – Provident Personal Credit Ltd
In regards to this account I can confirm that Lowell have now taken the decision to close this account and therefore, we would not look to you for payment towards this matter any further.

    Lowell Reference – 116370222 – Orange – Balance £191.71
I appreciate that the last payment may have been more than six years ago but this debt did not become fully due and payable until Orange issued a Default Notice – which you did not comply with. According to our information, the Default Date was 8th June 2010 and therefore we consider that the account is enforceable for 6 years from that date.” Looking at this account I understand that we have offered you a discount of 40% meaning a payment of £115.03 would close the account. Please advise if you would like to accept this discount and pay this amount to close the account? Please be advised that paying the account with a discount will reflect on your credit file as partially satisfied, and not satisfied.

Looking at your other accounts, please see below the discounts that have been offered:

    Lowell Reference – 148180672 – Three Mobile – Balance £191.20
As a gesture of good will I can offer you a 20% discount therefore, a payment of £152.96 would close the account.

    Lowell Reference – 162443774 – Orange – Balance £150.52
A 40% discount has also been offered on this account meaning a payment of £90.31 would close the account.

    Lowell Reference – 206029613 – Orange – Balance £525.72
A 40% discount has been offered on this account and therefore, a payment of £315.43 would close the account.

Please be advised that I am unable to accept your offer of £250.00 to close all of your accounts and Lowell are not obliged to offer a discount. The discounts above have been offered as a gesture of good will and this is the maximum discount I am able to offer you any further discount on these accounts and should you choose not to accept these settlement amounts the full balance of each account would need to be cleared in full.

Please advise how you would now like to proceed?

I have suspended collections activity for 14 days to allow time for you to reply. After this time the accounts will return to our collections department.

I look forward to hearing from you.

    Kind Regards,

    Emily

So I need some advice on this one

    Lowell Reference – 116370222 – Orange – Balance £191.71

    Is what there saying true?

As for the remaining debts they seem to have come back with a 40% discount for the rest but i honestly cant afford this in one go any suggestions.

So happy they have taken no further action regarding the Provident debt

There talking boolocks about the default date been the cause of action date.
Either Lowell employ monkeys, or they are trying it on, the cause of action date on the orange account would of been the date you last paid it, not the default date !!!

So that one is SB also, you need to tell them that.

  • This is how I have responded to Lowell

Thank you for getting back to me emily, I have consulted with some people and regarding the following debt:

    Lowell Reference – 116370222 – Orange – Balance £191.71
I appreciate that the last payment may have been more than six years ago but this debt did not become fully due and payable until Orange issued a Default Notice – which you did not comply with. According to our information, the Default Date was 8th June 2010 and therefore we consider that the account is enforceable for 6 years from that date.” Looking at this account I understand that we have offered you a discount of 40% meaning a payment of £115.03 would close the account. Please be advised that paying the account with a discount will reflect on your credit file as partially satisfied, and not satisfied.

As far as im concerned the date of action date would have been the last date a payment would have been made NOT the default date as u have told me. Im prepared to lodge a defense of this in court if needed please let me know how you would like to proceed or if you have any further evidence.

Regarding the discounts offered whilst im very grateful I just cant find this sort of money

Not sure what they will make of all that but i couldnt think how to word it
