Arrow global scam urgent

Hi all

I am a Specialist Welfare Rights Worker at a charity organistaion and currently helping a client who has been threatened with legal action over a debt he has no knowledge about. I have filed a defence and counterclaim. I know its a long shot but I have claimed for the sum they claimed against the client and also costs for distress as well as claiming fraud on the part of Arrow Global.

I was wondering if we could some how start a class action against Arrow Global for fraudulent and bogus claims which they enforce through the courts against vulnerable and disabled people who get scared by court action. These people pay out of fear of being thrown in prison.

We should not be bullied and allow companies to bully the weak and vulnerable. It would help my defence and counterclaim if people who have had bogus and undounded claims made against them so I can prove to the judge that they are using bully tactics and enforcing debts through courts which never actually existed.

Any help or advice would be greatly appreciated.

    I sympathise, and Arrow really are bottom scrapings from the effluent barrel, but I feel you may be on dangerous ground with such a counter claim.

    The accounts/debts almost certainly exist, although not uncommon for the wrong person to be traced and pursued for them, even through court. Arrow would undoubtedly claim an ** cough ** 'honest' mistake.

    Can you not get legal opinion via your charity/organisation?

    One particular client who was disabled and had never had a bank account was being chased for £500 but after questioning the debt Arrow stopped asking for any more money. Had we not helped him the threats and court action would have affected this persons health.

    We do not have much money to seek legal opinions and we are running short of time. I just want this client to not have to pay a debt he has not been provided any information about. The debt that he does remember owing is over 6 years old and i have raised the limitations act.

    Hiwever, i want these blood suckers to pay and stop doing this to the poor and vulnerable of society!

    Unfortunately this is the crappy, unfair mess we are stuck with.

    The entire system, from the way banks lend money they don't have, to the corrupt and downright dishonest debt collection industry, is rotten to the core.

    They break debt collection laws on a daily basis, they flout the data protection act, when it suits them, they lie, cheat, even to the financial ombudsman, who themselves suck up the crap thats spouted to them.

    I wish you luck, but your taking on an establishment with very little real regulation, it requires change way beyond what one court case May or may not achieve.

  • Thank you for your input. I know that I it will be hard but i want to give it my best shot. If i cant make a change for everyone as long as I can help someone it will be worth my while. I would say I thrive on challenges like this and with my client I will try to take this all the way.

    The law is the law so we will just have to throw the book at them. The judge can only apply the law so if we can prove our case then hopefully we should win.
  • Maybe an initial step is to get a sympathetic MP to raise the issue in the house; get the ball rolling that way leading to some kind of improvement of the whole system. I agree with Sourcrates, DCA are a law onto themselves and do need standing up to.

    You should request evidence of the alleged debt such as credit agreements etc if you haven't already done so.

    It's worth checking whether there are any Law Centres or Law Works clinics in your area and whether they can help with free legal advice.

    What we need to do is ask for the law to be applied. The law is the law just like the law defines a statute barred claim as unenforceable through the courts. Likewise fraud is fraud whether its perpetrated by an individual or a company.

    What these companies are commiting is fraud.

    I have applied for judgement to be set aside, a defence and a counterclaim. Does this stop the bailif being sent out or can the bailif still show up at my clients address demandin payment?

    I very much doubt a bayliffe will be used to collect a consumer debt, that's very rare, and wouldn't happen this quickly anyway.

    Bayliffs usually collect personal debts, unpaid council tax, or parking fines.
