I've had my YBS mortgate for 2 years now. When I took out the mortgage, I also remember being shocked at the lack of transparency involved with the legal referral fee (I was remortgaging).
However I concluded at the time that the offset mortgage I was getting was by far the best in the market at the time. They are are a mutual building society so I think it would be difficult for them to be accused of profiteering. They have to get to get the income some how., albeit, I do agree, it is a bit underhand.

You can console yourself that other aspects of the mortgage are very good value. I am now coming to the end of the introductory rate and the deal they are offering me to swap to is still very good value, with no fee, and has been very straight forward. I think this aspect compares very well to the rest of the market. Although you are cross about it now, I suspect you will be less so as time goes on, and will be pleased with it when you need to change deal at the end of the introductory term.
