Sick leave before Annual Leave

Hello,
I have been off sick for 6 days which I can self certificate for. But I go on annual leave tomorrow for 7 days.

As I have not returned to work do I still get holiday pay or is it still sick leave?

I would return to work tomorrow as per doctors recommendations but the annual leave is booked?

Any advice would be great.

Are you still sick? if you are you may be able to get a medical certificate and be able to have your time off as sick, thus freeing up the annual leave for a future date. That's what our (very large) company does.

My organisation states that if you provide a sick note for the period you were on AL then it will revert to SL.

If your still sick then it's sick leave and will require a fit note.

If you're no longer sick then either return to work or take your annual leave and let them know.

Surely if your doctor recommends you return to work you aren't sick anymore so it will be holiday pay rather than sick pay. If you are still sick then sick pay is payable and your holiday allowance is unaffected.

Jobs Ive had you were unable to go from sick onto a/l, a return to work of at least one day was required.

Some contracts do stipulate that....you aren't going to be trekking off around the world whilst claiming to be sick. You're going to be at home having cancelled the holiday so yes you should be able to return to work for one day then you can attempt to restart the holiday again if it is possible or you can rebook the holiday for a later date.

Bit late, but as the OP says they would have been fit to return to work tomorrow I'd have phoned work and said "I would be back at work if I wasn't going on holiday." And sent in my SC2 form by post.

I would have been speaking to my boss every day to confirm that I was sick, so I think I would have telephoned my boss to let him know that I still intended to take the following few days as annual leave.

You should contact your employer to say that you are going to start your annual leave as arranged. If you don't they may well still have you down as sick with no fit-note so no money
