I know about his poor performance because hourly/weekly reports are sent to the entire team so we all can see what we’re doing (and also to implicitly encourage competition). I can see therefore that his hours were the lowest and instead of being encouraged to improve his own bookings there were allowances made for him (clients were given to him, he shared the commission structure with the team) and there are people in the company who can attest to the fact allowances were made for him that aren’t being made for me. His billings became my business when I was being grilled on why the team hours aren’t growing.

Sorry but the chances of another employee testifying on your behalf are very slim indeed. Occasionally there is a principled individual who will do the right thing but the vast majority will become very forgetful for fear of their own employment prospects.

Sadly, you're right. Right now I have no power and it's a shame. And if I wait until I reach my 2 years of service then I won't be able to pursue this matter as I will have passed my deadline for raising and pursuing it.

I'll join a union today and take this one as a learning curve. It's unfair and I sincerely believe I am being discriminated against but I can't afford legal fees at the moment nor can I afford to lose my job with nothing else lined up. It is what it is.
