  • Hi there

The OR didn't ask me for a contract for the flat I was living in at the time. I have since moved and called to give them my new address, and haven't had to provide proof of that either. I did have to put my previous address on my bankruptcy forms though - not sure what would happen if you didn't do this.

I was terrified before the bankruptcy but I wish I hadn't wasted the energy as it hasn't been scary at all. In my court I didn't even have to see the judge, just a clerk.

I know you must be so scared, but just think of how relieved you will be when it's all dealt with. I honestly feel like a huge weight has been lifted from me - at the time I was trying to deal with a serious illness, potentially losing my job, breaking up with my fiance and having to move and it was all too much. The BR was honestly easier to deal with than any of the other things and now my life is back on track.

    Please try not to worry.

Thank you so much everyone it's just this living situation that's causing the problems. If the truth be known I'm subletting my friends council property, he now lives in America. If he finds out about the bankruptcy it's likey he will ask me to leave. My friend Louise is quite happy though to do me a tenancy agreement from her house, I'm just worried about losing my flat. As of December I will no longer be on an income anyway so I've no money that they can take. My partner will be paying all the household bills for me but there is no way he can take on my stupid debt. I guess the OR just needs all the details so as they know how much money they can take for my creditors. God, it's such a mess, I can't bear it.
You don't have much security in your friends council flat. Have you thought of declaring yourself homeless to get your own council flat. You have a much better chance now that you have a baby - especially if you are on your own.
I think this is something you should investigate, Susie. If the council find out that your friend has sub-let the flat to you, not only could they evict you, but your friend could lose the flat and (depending on how long you've been there) action could be taken against them for the rent they charged you. :( If there's a way for you to move to somewhere that's more stable before going BR, then I think you should take it - contact Shelter on the free housing advice helpline (0808 800 4444) & find out how to declare yourself homeless with your local council. If that's a viable option for you, then it could give you a secure roof over your head, which is what you & the little one need right now. :)

Apart from that, I can only reiterate what others have said. The OR can't have what you don't have, & they won't ask for it either. Your first priority is to get professional advice on your housing (as that needs sorting out whether you go BR or not), get your name on whatever lists you can, & then get advice on whether going BR is right for you & the implications. You can have a look at the guides on the Insolvency Service website as well. :)
  • I'm moving to my friend Louise's, I have changed my address and have let my work know. Louise is going to write a letter to my OR stating that I am now living with her and will be contributing to the bills. As I've done this then surely the OR will not be interested in my previous address as this is a money issue and not a housing one? I'm hoping that they'll just need to know what my outgoings are at the time of bankruptcy? I'm sure that the OR would only be concerned if I had a tenancy agreement anyway?
  • Oh, I am on the housing but apparently even with a baby I'm not priority until I am made homeless....

Of course you are not priority until you are homeless, that's the point. Your friend Louise could do you a bigger favour by saying you've been living with her but it cannot continue - you would then be homeless and a priority. You may have to go into temporary accommodation but you will get your secure property at some point and always have a roof over your head.

    :j :j

  • Thank you, I want this bankruptcy thing over and done with before I give myself a heart attack worrying about the housing situation. Seriously, I'm going to drive myself mad soon.
