Help Needed - Lowell Portfolio 1 Ltd, Lowell Financial Ltd & Halifax

I've now received the paperwork (statements & supposed credit agreement) which was sent recorded delivery so they know it was signed for. Sure enough two days later I received the typical letter from Lowell telling me they've done what they have to & demanding I phone them to arrange repayment.
The paperwork looks correct except for two pages which have a Lloyds header then my details hand written on to them. I've never been with Lloyds for anything. Do they own Halifax?
I am still out of work & have no assets so I have nothing to offer Lowell or for them to take. I'm trying to get back into work but the line of work I'm in means I can't get a CCJ.
My only hope is for a family member to lend me the money to pay them off but it would need to be a significantly reduced amount. How would I go about negotiating this? Is there a template?
Meanwhile I am making a complaint to FOS about Halifax because they are the only ones to have sold my debts after being told of my mental health & the lending code states they should keep it in house. They also added over £1k in defaults & charges after being asked to freeze the account.0 -
Hi,
Can you clarify exactly what they have sent you.

Hi sourcrates,
Taken me a while to go through it all, not helped by most of it being upside down and printed on the back of each other. It looks like Lowell received the info via fax and the Lloyds bank papers I found appear to be the fax headers... still a little confusing as Halifax is Bank of Scotland?!
So here is what I received:
# My Halifax Credit Card application details, signed and dated 12/11/2007
# Copy credit card agreement - not signed or dated
# Copy of Bank of Scotland Credit Card T&C's from April 2014
# Summary accounts for Dec 2013 & Jan 2014
# Copies of all Halifax statements from Feb 2014 to Nov 2014 (where I had stopped making payments & my father was trying to talk to Halifax)
# Spreadsheet dated from Dec 2014 to July 2016 showing Lowell account
Many thanks again for your help.0 -
Something else that renders accounts unenforceable are illegible documents, they must be clear and concise, and most important, you must be able to read them.
T's & C's from 2014 won't cut the mustard either, your agreement was 2007, therefore they should be too.
A undated credit card agreement is also suspect, although there is no requirement for a signature.
Hmmm, difficult to say at face value, see what others opinions are on it.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
