  • glentoran, you will find he would not have got his money back, since he had willingly given his details and therefore the bank deemed him at fault.

you give your details everytime you write a cheque, hand over a direct debit form, etc etc

It was an unauthorised direct debit that he did not agree to and therefore could have been reclaimed, This is different to willingly handing over pin number etc
  • I work with direct debits - he would have gotten his money back VERY easily. I remember this case, he decided not to claim his money back as it was to a charity.
Perfectly safe to give bank details out - never give card details willy nilly though!
  • all I know is that Clarkson gave an interview afterwards on tv where he stated that the money was gone and he couldn't get it back.

I've been in this situation, gave a buyer my sort code and account number, a few days later a Nat West branch in London phoned & said the gentleman had gone in to the branch & said he paid me by accident & could he have his money back.

I explained it was an ebay sell & I know he has the goods (signed for) she said 'I understand, I was just asking on his behalf as the money can only be returned with your consent'

Never heard anything else, they cannot take their money back.

I've sold a car this way too.

Decided it was safer than dealing with cash. Guy came to my house. Logged into his internet banking through my wifi - I gave him bank details and he made the payment there and then. Hit my account instantly and I handed him the car keys. Easy.

Checked with HSBC first and they confirmed this was a perfectly safe thing to do.
