I actually sought full residency which I got for 18 months, however it is now shared. I went for residency as I love my son, and social services gave me the choice of him going into care or living with me permanently due to concerns about his mother..... I hardly think this is me seeking residency to avoid child maintenance

Indeed not, but it's all the drama, surely that cannot be good for the child(ren) .
  • Quite right dudr, this is 4th time in 6 years she has attempted to go back to court / mediation, unsettling him each time
  • Any advice on my original post dutr now that we have cleared up why i went for residency (to stop my son being taken into care, and to protect him from his mother and her son who were identified by social services as being a risk to my son)

I'm not sure why you feel the court will go badly?
They work on logic not emotion, they won't change what doesn't need to be changed.
  • Because the courts in this country are a lottery.... And I'm trying to get advice as to how to avoid paying someone who is only interested in money IF things don't go my way at court

Sometimes you win the fight by not fighting, the law is already there to suggest that the non resident parent contributes, once that is in progress then the parent with care cannot ask for anymore than the suggested rate, CSA cases are no more, to set up a CMS case costs the PWC £20, that is not to say they will be succesful, as you already have shared care then you wouldn't have to contribute above what you already do, no one can vilify you as you are operating within the law.

For me, I contribute my 15% net and then that's it, the fee entitles me to be absent
If that's your attitude, it's probably best you're absent.

she has already tried making a claim (twice) with cms, she lied (twice) about her level of contact just to try and force me to pay....her attitude is why should she work and support her own child, she thinks i should have him half the time AND pay her to look after him......

both claims with cms were closed immediately
