After taking advice the upshot is technically it is unfair dismissal because I have not resigned. However if I want the £25k in to my pension pot that I am just going to go along with it because I don't want to jeopardise it and to be honest I just want it all over with now. However, the legal advisor has suggested I read the pension terms.Competition wins £14,136.30[\COLOR]0

If this is coming from the employer directly and not an insurance on the face of it seems a very good offer as by the sounds of it you wouldn't be going back to work any time soon and as such they could look to dismiss you via capability procedures and unless you have some contractual information different to standard employment contracts they can do this with just paying outstanding holiday and notice and nothing more.LuckyPenny wrote: »After taking advice the upshot is technically it is unfair dismissal because I have not resigned.
