I have finally cleared my mortgage. Unfortunately the provider, Abbey, have made such a mess of the whole situation that I have finally sent them an invoice for my wasted time and costs. The simple matter has been dragging on since early May and you just would not believe the mistakes they have made.
I have asked for compensation for my time and costs only to be ignored. I do not want to go to the financial ombudsman and be pushed from pillar to post for the next year. Has anyone successfully taken a financial institution to the small claims court? Any help would be greatly appreciated.
I am fully aware that Abbey were taken over by Santanda. I also bank with another institution taken over by Santanda; again their level of service has deteriorated beyond belief. Are Santanda driving these companies to the wall deliberately?

Without knowing the issues, I think you should write in and raise a formal complaint, they then have to follw a set procedure, and respond within time limits, then if you have no joy you should take to ombudsman.
If you do not follow this procedure I don't think you will get anywhere in the small claims court.I am a Mortgage Adviser

But for the last eight weeks all I have recieved from them is one holding letter saying we are investigating your complaint. They have never kept to a time frame. Even the head of Complaints has mysteriously added someone else to my mortgage?
I od not see why I should have to pay to train their staff and do their job myself? Would you?0 -
as apk1 says, do things by the book and you will get a satisfactory result.
Keep a copy of all letters and log times of calls taking receivers name.
Abbey will have to follow set timescales for complaints. If they don't follow them then it just reinforces your case.

I wanted to avoid the ombudsman at all costs as I used the banking ombudsman successfully in the past but it took three years. Even they didn't keep to their own service level agreements. I just didn't want to wait years and years.
I suppose we all have to accept that nothing gets done in the UK and the level of service is attrocious, hence the numbers emigrating from middle England! And guess what, I'm off too!0 -
