    What leverage is taken away?

    What will the letter achieve please? Do you think they may not have this information?

    (1) If you defaulted on payments in 2011, it can't be statute barred.

    (2) The most prescriptive part of the CCA on unenforceable credit agreements was repealed in April 2007 and does not apply to agreements made under that date, but can still remain unenforceable while they remain in default of a request, so may be worth seeing what they can supply.

  • Thank you for your response. I was mistaken, this card actually defaulted Jan 2011 and was taken out October 2007.
    When you say this card defaulted in Jan 2011, is that when you last made a payment, or when it was marked defaulted according to a credit reference agency?

    It can take 6 months of missed payments before a default is filed, but for the purposes of statutory barring, it's the first missed payment that counts, so I understand.

    According to noddle, the default date is Jan 2011. I am unsure as to when my last payment was made. Does this mean the statute barring may come in to effect earlier than the default date recorded?

    Yes, default date on your credit report is irrelevant for that.
