Hi everyone

My son has a debt issue but I am struggling to know what to do about it. Apologies for it being long winded, but any help would be very much appreciated.

Very simply, my son took out a Vodaphone contract in 2012. Shortly afterwards he went with a friend to the Vodaphone shop and transferred the account to her. (she had debt issues and was unable to get a contract - he realised that this was a big mistake, but he was naive at the time and thought he was helping her out. They are no longer friends) W

In Oct / Nov 2013 he was contacted by Vodaphone / debt collectors saying the account had defaulted. He explained that the account had been transferred but they said he was still accountable.

He went back to the Vodaphone shop and they said that it had transferred but his friend never sent some paperwork back. However when asked for a copy of the original agreement they said they didn't have it and it would be with Vodaphone, if it had been sent to them.

He received a couple of letters asking for payment and in return we used one of the template letters saying that we didn't acknowledge the debt and asked for a copy of the agreement. We heard nothing more. This was December 2013.

Today we were talking about houses and mortgages (he's just had his 24th birthday) and suggested a Noddle check, which came back very poor due to a default on his account since June 2015 to present day by a company called Lowell for "telecommunications".

Google search shows they are a debt collector.

He has not received any letters from Lovell and in fact nothing referring to the debt.

Where do we go from here?

Any help would be very much appreciated.

    NCO Lowell are notoriously bad at sending letters. I have a debt with a cataloge company that was passed to them back in September. They have never sent me any paperwork.

    I would try sending the template 'proove it' letter to Lowells to see what they come back with.

    I have trawled through the site but cant find the template? is there a link or particular folder to find it?

    Just to add, there won't be any agreement for an airtime contract, use of the phone, or SIM card, is concidered acceptance of the contract.
    Actual signing of a contract dosent happen.
    Proof would be in the form of airtime bills or a payment record.

  • I believe the bills were electronic, which he didnt receive and they only contacted him when she stopped paying.

    Contract would still be in his name you see.

    Companies such as Lowell buy these debts in bulk, they then decide which one are worth chasing, and which ones are not, they may contact him, they may not.

  • the default amount is £644 which my son cant afford and as they are just defaulting his credit score each month I think it needs sorting

    They are adding a default to his file but not his credit score, yes his score will drop but lenders don't see the score.
