nationwide default help

Hello I contacted nationwide yesterday to see about settling my debt. Whilst on the phone they said I had defaulted on the 12/12/12 which I knew was not true because I contacted them in July of 2011 when I thought I was defaulted so I raised a complaint. I've had a call back today from nationwide to say that they have made a mistake and it should have been registered in December of 2011 and wanted to give me £50 as compensation and change the date to December 2011. I declined as I no somewhere I have a default notice from them for July 2011 but I am of the understanding that if they are admitting that they have made a mistake then they should remove the default completely? What should I do?

as i understand it all they have to do is ensure that the information is correct. So in this case they would be obliged to correct it to the date they have now given you or your earlier one if you can persuade them that this was the case. I do not agree that they have to remove it completely, that would be innacurate obviously.
I am no expert but clearly they seem to have fairly sketchy information regarding this debt. I would ask them to prove it to me tbh. See what that turns up.£1000 Emergency fund No90 £1000/1000

Put your concerns about the default in a written complaint to them.
You can ask for removal of the default as compensation for the error, it is within there remit to do this, if they were so inclined, but of course they are not oblighed to do so.

If you believe the default on your credit file is incorrect then you should do a written formal complaint. Ask them to amend the date (or remove it - but this is unlikely if the data is correct) and if you are still unhappy with their response you can escalate things to the Financial Ombudsman Service and copy in the Information Commissioner (who regulates the credit files).
Remember, that the default of your credit file does not have to be the same date as the default notice issued to you in the post. They are 2 separate things. Have a look at the Information Commissioners Guidance about defaults for more details.

Hi Laura, quick question if I may please. Would the same apply to a debt that defaulted, then a year later the account number was changed and then defaulted again? I feel like I have been penalised twice for the same loan, which means I have to wait another 18 months to be free of defaults on my credit history.0 -
Hi Debtinator - yes the same process would apply. You need to complain to the creditor first and give them a chance to correct their mistake (or clarify how they could create another account number for the same debt - very strange). If it remains unresolved then escalate the complaint as I have mentioned. Good Luck

Thank you Laura. A new account number was created as I made a PPI reclaim after being mis-sold it.0
