Nursery Fees

I'm in debt already with other creditors to the tune of 26000 pounds and I also owe the nursey 3500 pounds.

I had a discussion with the owner and agreed to pay the weekly fees of two hundred pounds plus ten pounds to the arrears and the funding my son gets will be took straight off the arrears. Only problem is two days later and I don't have the two hundred and ten to give her.

I've just been made permanament at my work and now get paid monthly. I thought my last weekly pay would be in two weeks time, infact it was last week, so the money in the bank has to last 3 weeks for food, petrol, and bus fares!!
I gave her fifty pounds and a letter explaining why( as shes not their when I pick the children up), but I know she's going to go mad!!

What can she legally do?

    Withdraw your child and then the usual procedure which is to send a bill, send a reminder, send a final notice then court for a CCJ and then if it's not paid, send bailiffs round. If she's being really nasty then as you owe more than £750, she could in fact bring bankruptcy proceedings against you but that'd be a very last resort and she'd have to prove she's gone through the first steps.
  • if she does stop your child attending nursery she will not be able to claim the funding for the autumn term or if she gets it she will have to pay it back if you child is withdrawn.
    it is beneficial for her to get the money off you,
    I was treasurer at a nursery for 3 years and we had bad payers, but nothing like yours, we used to nip it in the but when it reached £300 mark,
  • If she withdraws my children from nursery she's got no chance of getting her money back as I want be able to work!!
    If shes does go that route and impose a CCJ, my financial statement will prove that I can only pay 1.00
