Sell 50% of inherited house

Is there any way I can sell my share of a house I inherited, brothers refusing to sell/buy me out. They can live there for 10 years. Or any other way I can free up £125000 of £250000 house.

    You could, but finding a buyer is going to be near impossible.

    You can force a sale through the courts, so I would threaten him with that and if he still won't budge carry out the threat.

    PS. Is he paying you rent for your half?

    Was that stipulated in the will?

    If so, it's unlikely that you will be able to sell while they have the right to live there, even if you could find someone to buy it.

    Your share wouldn't be worth anything like 50% of the value of the house while your brother is resident.
  • OP turn the question round and answer this - would you buy a half share in a property where you had no income or say in what was done to it?

    I know the answer I would give you.

    Take out a mortgage on the house, your Brother will need to be named on the mortgage as well.
  • Firstly, sorry for your loss - it sounds like you both have lost a parent.

    So you own this house jointly with your brother but you want to sell and he wants to live there?

    In that case, you could take out a mortgage for the £125k so you get your money and he could rent your half off you, which would hopefully cover the mortgage. Obviously you would income to support the mortgaged amount and need to talk to a solicitor to draw up an agreement that is fair to both parties.

    Is your brother underage or otherwise vulnerable? Or does he just want to live in the house himself? Might he want to buy your half off you in the future? Or sell up and move?

    He can't have use of all the house and leave you with nothing, which sounds like the situation is currently.

    He/they can do if that is what the Will stipulated and the OP does mention a specific term of 10 years.

    What exactly did the will say?

    You may actualy own nothing just a future beneficial interest in 1/2 a property.

    No mortgage lender would lend to OP under these circumstances
