Mortgage Offer not same as KFI (long)

  • I've got my KFI-it quite specifically says in section 10 "what happens if you dont want your mortgage anymore" that the ERC is applicable until Aug 2007. That's why I dont understand why its changed in the actual offer?!

    What I havent got is a copy of the terms last year as I just responded to a mailshot. Hopefully my advisor will return on Monday, and he is going to get stalked like crazy until this is resolved one way or the other

    Make sure your complaint has been logged. There is a long backlog but will get round to it....

    I believe that the mailshot that you signed was not clear re an extended tie-in as have heard this complaint recently. You will have the ERC waived.

    If you dont, how do you know the above, and do you know anyone who has actually had it waived?

    I don't believe you would ever have got a rate of 4.45% fixed for 1 year without an extended tie-in.

    So the KFI was almost definitely wrong, and the offer was almost definitely right.

    As others have posted, the offer is the legally binding document and you should have read it before you accepted the mortgage. And your solicitor should have explained its key terms to you.

    So this boils down to you being incorrectly advised that you didn't have an ERC after 31/08/07.

    Given that you stayed with Woolwich in any case, the only reason you've lost out is because you rather petulantly decided to bin Woolwich off a few weeks after moving house. Your Britannia costs were incurred by you as a result of you not understanding the mortgage you'd bought from Woolwich, so I don't see why Woolwich should compensate you.

    If your circumstances had been different - e.g. you'd delayed your move until 01/09/07 and then taken a new mortgage from a different lender because you were told that you were out of ERC, things would be different - your costs would have been directly caused by incorrect advice from Woolwich. But that's not really what happened here.
  • UPDATE

    Just had a call from Customer Relations at Woolwich responding to my complaint. It appears to have worked.
    They stated I WOULD NOT HAVE TO PAY THE EARLY REPAYMENT CHARGE.
