Payday Lender Complaint Query

So I've sent a complaint to Uncle Buck about unfair affordability checks and roll overs etc.

This is the response I have had today:

I am writing in regards to your recent complaint.

In order for us to complete our investigation in the most thorough and appropriate manner can you please send us copies of your bank statements for the period covering the time of the loan applications? This will enable us to get a full overview of your financial situation at the time of lending to make the best decision regarding your complaint.


Would you send these to them? Are they entitled to them?

    NO! this is just another delaying tactic from the lender, just e-mail them back and say you will be forwarding this info to the FOS along with your complaint.

    Hi,

    No, they are not entitled to anything, and you don't have to send anything.

    I find it a strange request actually, you can refuse to do so, but they will probebly use that as an excuse to dismiss your complaint.

    So it's up to you really.

  • I just got £2k back fro Wonga before Xmas due to a complaint about affordability of payday loans. They should have assessed your affordability based on the information you gave them when you applied, they explained this to me in great detail when they upheld my complaint. They didn't have access to your bank account when they assessed you therefore its irrelevant to them now. In fact their reply actually implies that they didn't have access to your financial situation at the time, which may mean they shouldn't have lent to you on the basis that they didn't know if it was affordable to you.

    I certainly wouldn't send my bank statements in. I'd be refusing on the basis that its not relevant, because what you are querying is the affordability assessment carried out at the time that they issued your loans and this would have only been based on the info they had at the time.

    I paid off my credit card with it and put the rest in the kids savings account - it felt really good :)
