Homeground Ground Rent Payment

PLEASE HELP!!

We live in a new build house which is managed by Homeground management ltd. The company has no telephone number and can only be contacted via post or a generic online email address.

We were due to pay our ground rent at the end of 2015 a lump sum payment of £150.00 but could not access our online account. We then sent them an email asking for assistance and recieved an automated response back saying the our email would be dealt with in 3-5 days which would have taken us past the payment deadline. In order to try and resolve the issue we arranged for the payment to be paid direct into there back, account details of which were supplied within there original request for payment. We sent them an email expalining the situation and confirmed the bank account we were paying into and recieved no response.

We have since had 2 reminders saying that the account is overdue both times we have contacted tehm via email to explain we have already paid but with no response? We have now just received a letter saying that a £45.00 admin fee has been added and that if the account is not paid by the end of the week then the issue will be passed to solicitor!! I immediately sent an email to them and attached all the previous emails and even a snapshot from our online back showing the payment had left our account and a timeline of events.

I have also filled in an enquiry form with the financial osbudsman to ask for advice but obviously we need ti get this resolved by the end of the week to avoid more potential charges.

Can anyone give me any advice on what to do?

    I am having the same issue with homeground with ground rent. I have not received any correspondence asking for payment of the ground rent and as such I was not aware of the demand for payment. I have since received a letter from their solicitors incurring costs of approx £500 they want paid. I have had no reminders regards overdue payments nothing to let me know my ground rent is due. Homeground are notorious for not listening to people. All they want to do is take money unscrupulously. They offer no asisstance whatsoever.
    Does anyone know of a solicitors to which this can be taken to? Surely we are not the only ones suffering they unprofessionalism. Please can anyone help.

    If you've got proof of payment then there's no problem , they could only try to recover alleged debts after going via a court , your proof woul stop that dead

    Tell their solicitors you will see them in court as you have proof of your payment

    Ground rent is only due once requested, so they can forget about the extra admin fees. Pay them the original amount required in your lease for the years you haven't paid and say "see you in court" if they want anything else.

  • I received the legal letter from JB Leitch this morning. There is some good advice further back in this thread so its worth taking the time to look back to late 2015 posts. I will be registering complaints with City of London Trading Standards and the Financial Services authority re Homeground, The law society re JB Leitch and anyone else I can think of.

    PLEASE HELP !
    I just came back from week holiday to find letter from HOMEGROUND with NOTICE OF LEGAL ACTION inside.
    It state that my account is now "severly" overdue and solicitors (JB Leich Solicitors LLP) will now be instructed to commence recovery proceedings and no further correspondence will be entered into by homeground.

    I didn't receive any invoice since 27th July 2017(which was for property insurance).
    I have asked JB Leitch to email me copies of correspondence which they insist was sent to me:

    - Invoice on 15th November 2017 for £250
    - reminder 26th January 2018 £250
    - 2nd reminder 14th February 2018 including £295 (£45 late fee)


    - 16 March 2018 letter with NOTICE OF LEGAL ACTION and £395 to pay (£100+£45 late fees)
    + £222 that their Solicitors charge!

    I didn't receive any letter/invoice from them between July 2017 and March 2018!:mad: only last one 4th letter on 16th March 2018

    How can I prove I didn't receive 3 out of 4 letter!? why things like that are not signed for?!
    Their solicitors told me that it's my responsibility to contact Homeground and pay even if there was no correspondence delivered! Really?
    I'm hoping that someone here can guide me on what to do, I have never failed to pay bill in my life, they treat me like criminal!

    According to JBleitch, Court will stand behind homeground. BUT!

    My argument is that:



    1. If Homeground sent 1 Invoice and 2 reminders first class and I didn't receive it, then how this can be my problem and why would I have to chase up Royal mail if THEY (homeground) paid for postage to be delivered - not me.

    Seriously I can understand Royal mail could loose 1 letter perhaps 2, but 3? out of 4 ? this doesn't add up.



    2. What would I even possibly gain by pretending not receiving them? I never had issues before paying.

    3. They produced digital copies of all 4 letters (including missing ones), buy how can I trust that they are not forged? they could "make" them at any time. Even if it's outsourced to other company that sent them letters for them, then what guarantee do they have that letters were actually sent?

    4. JBleitch say 1st class letter is "good enough is deemed as good service by courts", but hey looks like is NOT GOOD ENOUGH as some % of letter are not reaching their clients. Recorded of signed for would be 100% GOOD ENOUGH :) divorce papers are always signed for!

    5. This smell like money making scam from miles.... in my honest opinion they could well be behind it on purpose.
