PIM2505-When to claim estimated Council repairs

    Q. 'I am taking out a buy-to-let mortgage for a new rental property but the arrangement fee will cost me about £2,000.
    I know I can offset items such as mortgage interest against rent and claim for agent fees, council tax and ground rent on my tax bill. But can I claim for the mortgage arrangement fee too?'

    A. 'The HMRC Property Rental Toolkit states, 'The incidental costs of obtaining finance that are wholly and exclusively incurred for the purpose of acquiring the property are normally allowable.'
    That is distinct from fees incurred in the purchase of the property such as surveyors fees which are typically treated as capital and therefore not allowable.
    A spokesman for HM Revenue and Customs replies: Relief can be claimed on the initial expense of securing a mortgage for a business property. Guidance on the expenses that can be claimed can be found at BIM45815, BIM45825
    Marc Shoffman of This is Money replies: The mortgage fee should come under point D of HMRC's guidance on allowance expenses 'commitment fees for an undertaking to make a loan available More information can be found in the section on 'procuration fees.'
    Helen Relf, Tax Director for Baker Tilly, replies: In general, deductions are allowable where they are incurred wholly and exclusively for the business, i.e. for the letting of the property.
    Therefore, in reply to your query as to whether it is possible to claim relief for fees paid in obtaining a buy-to-let mortgage, a deduction is allowable against rental profits provided the mortgage is specific to the property being rented out.
    If any part of the mortgage is for personal use, a proportionate amount should be considered having regard to the value of the funds not applied to the investment property.'

    So I think I can claim for the arrangement/incidental fees as there is nothing in these BIM docs that says there is a time restriction to having to arrange the loan in the same tax year as the claim? Also it seems ok due to BIM2505. So not sure why the Which? video says there is a time parameter.
