That is a fact that your current employer will disclose.
I would imagine that the new job would be conditional on that employer receiving suitable references... have they contacted your current employer yet?:hello:0 -
Let me clear this up a little.
I applied for the job (which has the training I'm starting next Monday) back in November. I was accepted onto the training course for January. My boss wouldn't allow me to take time off then he had more than enough notice for this holiday (nobody else on holiday at that time). So I had to delay the training until February. I was always going to resign from my current job as the hours are very up and down. I don't get paid holiday pay when I'm off, it's paid each month so every time I have time off I get into debt. I was waiting until I got paid this month and also to check that I had been paid my Xmas bonus before I resigned. Unfortunately this suspension has taken place a week before I was paid. I am not guilty of anything here, I am a victim of the neighbour who has fabricated something against me, that didn't even involve me at the time, I just happened to be there.
I don't think you realise, but it isn't about clearing it up. You work with vulnerable people. You are moving to a job with vulnerable people. That means that resigning whilst being investigated for misconduct / gross misconduct goes down on your employment records, and in this area of work employers are required to share this information. You may think you are guilty of nothing - the fact is that you have not been found not guilty of it. So it stays on your record. The way that you get to be not guilty is to stay the course and win the disciplinary - or be found to have no case to answer. Resigning and walking away is not an option. You have chosen to resign and walk away - that does not mean that it will simply go away. What you are describing may be what you know to be true - but it is not the way anyone else must interpret the facts, and the reality is that employers seldom believe that people are innocent of allegations of misconduct when they resign rather than await an outcome. What is worse, for you, is that whilst they should/must share the fact that you resigned whilst being investigated, they ought not to say what for - so they ought not to verify your version of events, because the facts of the investigation are confidential. On that basis, you could be being investigated for absolutely anything - and thus for things a lot worse too.0 -
I am under investigation for a lie made up by a neighbour, as I have previously said it was to do with him and another person I was just witness to what happened. I have done nothing wrong. I'm not choosing to walk away from it these were my plans all along. I cannot help this suspension has happened a week before I resigned. I needed to resign at this time so I can start as soon as I can at the new job. I will clear my name before I leave. I am starting 2 weeks holiday to do my training for this new job. The disciplinary meeting will take place the last week I am back at work. My new employer has references from my current employer already.0

Did your current employer give you this reference before the allegation was made or after?
