ppi after bankruptcy

I was discharged from my bankruptcy 6 months ago. I didnt pay anything into the bankruptcy while i was declared bankrupt and i am not on a IPA or IPO if i was to get any cliams from.ppi would i have to tell the offical receiver??? Or will i be able to keep the refund sent to me. They had no contact or intrest since my discharge???

    The PPI is an asset in your BR and will go straight to your OR. If you pay some one to do it then you will be left to pay the fees with no PPI to show for it.

    The money belongs to the official receiver.

    They have not put me on an IPO or IPA.

    That doesn't matter. The money is not yours. It is an asset in your BR and not yours to claim. If you claim it the firm will do a BR check and automatically send it to the OR.

    As I said please read the sticky post on PPI.

    Then you should contact the OR and ask how to forward the money to them.

    Well then someone didn't do their job correctly. The IS are gradually doing claims on PPI and claiming it. If they find you have kept it without informing them they can claim it from you.

    Email the OR and tell him. If he emails back to say you can keep it, that's a bonus. But keep the email just in case you need proof at a later date. If they ask for it then you can transfer the money.

    When you went BR, you signed a load of paperwork - amongst which was a document confirming you understood your obligations whilst BR, and explaining the potentially serious consequences should you breach your obligations.

    As everyone else has said earlier, there is absolutely zero doubt that the money is NOT yours and belongs to the OR. So, if you were to try to keep it without telling the OR, not only will you have to pay it back when the OR finds out - but there may be a lot of other nasty & unintended consequences into the bargain.

    If you get on the wrong side of the OR (or they want to make an example of you) and try to keep the money, they could well technically go after you for theft, fraud, obtaining money by deception and quite possibly various other breaches of bankruptcy legislation too (most of which could result in criminal convictions)

    But, if you do what you should do and write/email the OR to let them know, there is a possibility they will just tell you to keep the money anyway - as they have done to a few other members of this forum.

    Most of us are going through / have been through the same situation as you, and it's tempting to try and keep the cash. But if you try to do this, the best outcome you'll have is you'll be looking over your shoulder for at least the next 6 years and panicking whenever an official looking envelope arrives.

    It's no different to those people who moonlight and do "cash in hand" work while on the dole. Yes, it probably seems tempting, and yes some people get away with it. But if they catch you, they will usually throw the book at you and do you for fraud.

    Personally, I would rather sleep soundly at night after all the BR stress.

  • Ive emailed the receiver. Ive not been in bankruptcy for 6 months now.or paying any IPA. Fingers crossed this will help me.keep the money.
