PPI Reclaiming - Fuzzgun Vs M&S Money

    Hi, lenders have a major issue with ppi. Technically the way this cover is set up forms breach of contract. It is far more critical when it is single premium added to the loan, however there is still a valid claim against your bank.

    I would leave it a while as we have a number of test cases with solicitors at this time. keep in touch and I will advise how these cases have proceeded.

The grounds for my claim are (a) as I am the sole director of two small limited companies, (b) I have a "history" of breast cancer, and (c) I was not told that I could buy "stand-alone" cover (which would have been cheaper), the PPI was mis-sold to me. Apropos (b), I think that just saying - in the little booklet they send you - that pre-existing medical conditions are not covered is too blunt when it comes to things like breast cancer (for which I was treated, successfully, 17 years ago). I am certain that, had I subsequently been diagnosed with ANY form of cancer (ie even if it were shown that it was not metastasis from the breast cancer), I would not have been able to claim against the PPI.

  • I have been corresponding with Lloyds TSB re PPI on a credit card since October 2007. First of all I asked for details of total amount paid, didn't received this. I then asked for a full refund which they refused. They sent me a copy of the agreement with my signature. Obvously someone had filled it all in and it was sent just to be signed.

    I then passed my case to the Financial Ombudsman, on 26th January I received a letter from them stating that they will pass my compaint to a case worker. I have had two further letters, the last on 25th March saying that they are so busy they have not yet looked at my case.

    It looks like there's a long road ahead

    You are almost certainly correct and you stood no chance of claiming on the policy. the good news for you is that because of the ppion your loan you can challenge the loan itself. Even better news is that you can do this even if your loan has been repaid. So get digging those old agreements out.

    Just an update.
    Just had a phone call from the ombudsman, asking a couple of questions. Not sure why they called me, as I had already answered the same questions in my claim form statement...
    The ombudsman guy said he had more questions for M&S Money, and would be in touch.

    This is taking ages!
