Getting Paid.

Hi. I recently completed a job for a company and it now appears that this company has (I think) gone bankrupt. During a phone call with one of the partners (very poor signal) he mentioned Registers and other terms which at this moment I can't remember. The partner assured me that he did want to ensure that I get paid, but proposed that he does so through installments as and when he can afford to do so. Part way through the job, I did ask for a part payment and he did find £1300. I want to believe that he will pay the outstanding £2700, but I was wondering what assurances I should be asking for or steps I should be making to endure I get what is owed.

If they have gone BR then it will not be up to the partner who gets paid, if he did pay you over other creditors this would be viewed as preferential treatment which is not allowed in BR.:pB&SC No. 298

and if he has indeed been declared bankrupt sadly you'll be treated like all other creditors who are owed cash from the companyNot quite a newbie as you think

A key point being that if the partner does make a payment to you as dojoman rightly says it will be views as 'preferential' and the OR has the power to reclaim that payment back from you.0
