A DCA has now written to me 3 times:
Letter 1: Please pay the outstanding amount immediately or call us to discuss repayment options
2: Please don't ignore this letter, call us now to pay immediately or to discuss repayment options.
3: You have responded coz you have no intention of paying or are unable to. Please don't ignore your debt. If you don't call us we can't help you. ARRIVED TODAY.
Problem is I have no idea who the debt is owed to? The DCA quote a client I have never heard of. So I'd like to respond by asking them for more information coz I've never heard of their client. Is this the right thing to do? Any ideas anybody? All of the creditors i know off are relatively happy!

Can you give us the DCA and the clients name sometimes companies change names.
There is a letter you can write to request more information the onus is on them to prove that you are the person and that it is a valid debt but you are better corresponding in writing and not ignorning them.0 -
I agree with Rayday - we need more information before pointing you in the best direction.
There are, currently, some pretty big 'scams' being operated by some DCA's, who are targetting people over 'alleged debts' that are, in law, no longer recoverable through the courts, once the 'alleged debtor' has told them that they won't be paying.
Unfortunately, the DCA's are not advising these 'alleged debtors' of their rights, and many people are falling for this 'con' and simply paying up.
We wouldn't like to think that you are one of these unfortunate victims.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Okay, the letters are branded "ECI Debt Collectors" but the company is called "Credit Ancillary Services Limited". They quote their client as being "Equidebt Limited".
Do you know where I could find a template letter for asking for more info? I looked on NationalDebtLine but couldn't see one.

Firstly, chill.
Are you in debt a lot? Or could this possibly be a DCA who has picked you out as you have a similar name to someone who DOES owe money to them/their client? DCA's sned thousands of these letters as eventually they will get the right one, PLUS the possibility of several people just paying up the same debt becuase the individuals concerned do not know any better.
Anyhow - send them the £1 fee and the letter asking for a copy of the Consumer Credit Agreement. (Copy on National Debtline, or search these boards - I cannot post a copy as I do not have one on this PC) The CCA will show and prove whether or not its your debt. And they cannot enforce (through legal means) a debt if they do not have this agreement. So do this ASAP.0 -

Okay, I've amended the letter to:
Dear Sir/Madam
I acknowledge no debt to your company, and require further information.
Please send a copy of the credit agreement and a full breakdown of the account including any interest or charges applied. I understand that under the Consumer Credit Act 1974 (sections 77-79), I am entitled to receive a copy of any credit agreement and a statement of account on request. Please find enclosed payment of £1, which represents the fee payable under the Consumer Credit Act 1974.
I understand a copy of any credit agreement along with a statement of account should be supplied within 12 working days.
I understand that under the Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with this request for a copy of the agreement and statement of account under these sections of the Act.

I am in lots of debt, so this is probably legit - but i don't want to pay for something i don't owe!
Any comments on the above letter would be appreciated.
