Sorry. My comment was a suggestion based on the fact I have neither seen the insurance documents nor the leasing agreements. Obviously you have to know what the key points in those documents are. If there is a dispute about the terms of the employment contract, that is one thing - these two documents are not related to that. Without knowing what their terms are, then I wouldn't hazard anything other than a suggestion.
But as others have suggested, there is more here than meets the eye, and I suspect that people are right that I would be expecting garden leave to be cancelled quite soon. Or possibly a disciplinary for refusing a reasonable request and withholding the car from the actual contract holder. That's probably gross misconduct and wouldn't take more than a couple of days to action. Amongst several ways (there are others) that the employer can get back. Handing in ones notice doesn't mean one can get away scot free. No matter what the contract of employment may say, there are always ways for an employer to hit back.
I suspect that this wasn't an amicable parting and is likely to get a lot less amicable.0 -
YOu probably need to look beyond the contract and potentialy other implied T&C of the actual company car policy, which may have additional terms..
Probably best to ask the employer on what basis they belief they can ask for the car back and go from there, rather than the hardline aggressive approach.0 -
What's the wording in the contract? Does it say you have use up to the last day of contract or that it must be returned on last day of contract?
If its to be returned by last day of contract I suspect they'd be well within their rights to ask for it earlier.
I work in a fairly 'small/connected' industry, if it were me I'd just return it to keep relations good.
Guess your situation might be quite different and unexpected gardening leave wasn't something you expected!0 -
Sorry to go off topic or take over your thread, I've also got a company car, I'm currently looking for alternative employment, if I leave, will my tax code automatically revert to a standard tax code with out a company car?0
