Parking eye ticket being cancelled but still receiving letters

As keeper of the car I received a letter with a £60 charge for parking on Boxing Day in a hotel car park from parking eye

I called up the hotel and they have contacted parking eye to get it cancelled. They said they can't guarantee it however. I have this in writing.

This was earlier in the week. Today I received a reminder letter from parking eye and am a bit lost at what to do.
Should I still appeal in the normal fashion as well or wait to see what happens with the landowners?

    You can't afford to wait with ParkingEye, it is generally those who don't engage in their appeals' process who are first in line for a county court claim.

    It may be a case of 'letters crossing in the post', but there are examples around the forum where the contract holder (be it retailer, hotel, retail park) failed to inform PE, probably a case of work priorities taking over and the promised cancellation slipping their mind. So be on the safe side.

    You haven't given any dates in your opening post, but if you're still within the PE appeal period (28 days), then use the ready prepared appeal in post #1 of the NEWBIES FAQ sticky - use it 'as is' but put in a final paragraph, enclosing a copy of your written confirmation of the cancellation, to highlight what the hotel has said to you.

    Get in touch with the hotel again, stating that their agents, parking eye are still harassing you over this charge, and that as principal they are equaly liable for their agents ( parking eyes) actions, ask them again to cancel, as you do not wish to have any more of your time wasted as a result of the Hotels actions.
    You could also add a bit on how you are shocked that the Hotel thinks it appropriate to allow a predatory parking company who aggressively chase after people, h arras and intimidate and bully them into paying up

    Also mention the above ( and the parking prankster article) on the hotels facebook/social media/trip adviser pages asking if this is an appropriate company to represent the Hotel, and if the Hotel believes this is, then people should stay clear.

    You need to WARN the hotel that this horrible firm they have let loose on their customers will sue you in court.
    They have an opportunity to mitigate that loss and that will be your defence, a full counterclaim for the loss against the hotel that employed them.

    This tactic would teach these people who they are in bed with.

    Do the appeal via the online portal - it's their standard procedure. Take a screen dump before pressing the 'send' button as I'm not sure whether you get an auto-response receipt. There's an 'attach file' button to use in forwarding a copy of the hotel's cancellation confirmation. Again, attach it before pressing 'send'.

    There's a limit to the number of characters you can squeeze into the appeal text window, but the sticky appeal template plus your final paragraph should fit. If it won't then type it up in Word and attach it as a .pdf file alongside the hotel's confirmation. Just type 'See appeal attached' in the text window.

  • I appealed using the online portal. I sent them the response from the sticky as well as a paragraph mentioning that the landowners have contacted them and sent them a printscreen of the email the landowner sent me.
    I printscreen my response before pressing send.
    All I can do is wait now right?
    With the landowner contacting them how likely is this to get cancelled?

    It's rare for PE to ignore a landowner cancellation in the early stages following the issue of the PCN (they're more stubborn if the case gets to the point of them issuing court papers - there's a current thread doing the rounds at the moment about this).

    PE are also good at writing to the motorist to confirm they have cancelled the charge - normally within 7 days or so of the instruction from the landowner.

    As I said earlier, at this stage you have to err on the side of safety, should the landowner have forgotten to instruct PE.

  • I called them today after receiving a reminder from PE and they said they sent the email/ letter the day I contacted them as well as an email to me saying they've contacted them. How long should I leave it before asking them about it again?

    35 days, that's how long they have to respond to appeals. But PE will likely confirm it's cancelled by email by next week.
