The above post has now been closed but I want to ask a question.
My daughter was moved roles in a Company about 18 months ago.
It was a temporary move but she is still there.
She has just found out today that she has been overpaid around £3,000
She has been doing a lot of overtime and just bought a house with her bf based on the back of her salary and overtime payments. (25 years, £200k mortgage)
She has been querying the amount for about 12 months with head office on a regular basis and head office have come back lots of times and assured her it was right.
Where does she stand?

Mrs K3 had a very similar situation and despite the fact that we had in writing from the employer on 2 occasions that the salary paid was correct (complex with bonuses, temp promotions, weighting etc etc) she still paid back (albeit over a 5yr period). Legal advice suggested that it could go either way and had she not still been an employee they 'may' have advised to refuse payment but not as a current employee.
More complicated in your situation is the c.£200pm drop (plus any repayment agreed) and whether this is affordable given the recent mortgage
I'd be weighing up the options given here and then either seeking proper legal advice or a discussion with employer (depending on size and how amenable they are/how likely she is to stay)0 -

I'd have to ask why she secured a mortgage based on her salary if she suspected it was incorrect? Did HR confirm her salary was correct in writing?
Is she going to be able to service the mortgage with a lower wage?
She'll need to pay the overpaid wages back and will have to make an agreement with her company. I'd suggest she offers to pay it back over the same time frame she received it.0 -
Ask them that as they have confirmed many times that it was correct that they wipe the 3k and she goes to the correct amount from now on?ronaldadio wrote: »https://forums.moneysavingexpert.com/discussion/2921400

Where does she stand?Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0 -

Yes, plus when she had email the head office 4 times she just assumed what they were saying was the truth. They actually made an additional payment to her before Christmas because they had underpaid her.
Is she going to be able to service the mortgage with a lower wage? YES

Then I'd be looking to seek independent legal advice.0
