Employer problems (garage)

So just before Christmas I was told not to bother going back to work in the garage where I am an MOT Tester. I was late to work on several occasions so thought ok no problem.


Now the employer is saying I cannot get my tools out the garage. This consists of a Snap on tool box and tools worth £6000-£7000


If they refuse to let me get them collected where do I stand? Im not wanting to collect them in person as it will only agrivate the situation so I was going to send a friend or a courier to get but tere saying I cannot have them.


Is this classed as theft then? surely if they are my tools and they refuse to let me take them then its theft?

    What is their reason for refusing you your tools?
  • Customer took their car to VOSA claiming it shouldn't have passed an MOT and my employer sais they are getting police and VOSA involved in it. It is null and void as its outwith the time scale to claim as it was MOTd 3 months ago and is totally a separate issue.


    My problem is how can I get another job and earn a wage if I haven't got my tools to do so? Hes basically being a child.

    Turn up to collect them and if they prevent you then call the police. Take as much proof of ownership as you can with you.
  • If there intention is to deprive you of your tools with no way of getting them back, they are guilty of theft.
    How long had you been working for this garage - more or less than 2 years??

    Torts: Interference with Goods Act 1977, write a letter stating that you will go to court and they will be liable for costs.


    If you wish, contact the police before that, explain that you wish to go collect your belongings but fear a 'breach of the peace' and would like the police to attend to prevent it. (DO NOT MENTION the civil claim).


    Report theft only if you are actually prevented from taking tools. If they touch you, that's assault.

    Id put in writing that you at a set time and date will be attending the premises to collect your belongings and that you will be accompanied by at least two other people due to the weight etc of the said items. They can not hold your belongings even if you owe them money in wages etc. On a separate note a garage (main dealer) close by got caught when a tester was bringing in cars for friends family etc and just issuing a ticket, They got caught because as you know its all computerised now etc on the test times etc. They were asked how could they have two cars on the test bay and brake tester etc at same time as there was too little gap on the timings etc. They garage set the tester up the nesxt time he bought a car in they put a stone on the wheel dinner time came and the car had a ticket on the dash and the stone still sat on the wheel. he was dismissed that day and he had been there a long time.
