Primark refund advice..

I'm not sure if I've posted in the correct place so feel free to move me! :) I need advice on a refund. I purchased a pair of thermal leggings in Primark about a week and a half ago. I have bought items from Primark before so I am well aware that they do not accept refunds on briefs/boxers, cosmetics and pierced jewellery. The staff will usually tell you this as you buy it, as is done in most high street shops.

However I was not told by any member of staff that thermal leggings could not be returned or exchanged. Futhermore, it does not state this on the refund policy printed on my receipt, it refers only to briefs and boxers:
"We are happy to give a refund or an exchange on any purchased item provided items are returned in saleable condition with a receipt. No refund or exchange on briefs/boxers or brief sets."

Primark have told me that the leggings are "classed as underwear" and therefore cannot be returned. This makes no sense to me as bras, for example, are "classed as underwear" and can be returned in many shops throughout the high street. Thermal leggings may be seen as underwear, but they are not underPANTS.

I know my rights if the item were faulty, but I am a bit confused as to what to do in this situation. It is not required by law to have a refund policy, but I thought if a store has one then they must stick to it? A pair of leggings is not a huge deal, but Primark have annoyed me one time to many with their ridiculous excuse for customer service!

    I'm no expert on womens clothing. But for mens clothing, thermal long johns are underwear and I wouldn't wear anything underneath them, so I don't expect a refund.

    Women's thermal leggings are usually designed to be worn with underwear under them, they don't have the gusset like long johns, they are to all intents a pair of leggings. Plus they have a line of stitching between the legs, which I imagine would cause some chafing in the most intimate of areas!
  • According to consumer law, if the goods are not faulty then you legally have no rights to return (!)... unless they have a published returns policy. Have you checked the returns policy carefully? It could be worth arguing your case?

    Unfortunately, unless it explicitly details what constitutes underwear, they may be able to decide themselves.

    OP, try a different branch of Primark and see if you get any more luck elsewhere.
