Hi,

I wonder if you can help me as I'm panicking slightly! I have today received an order from the high court (chancery division) substituting RW for MDKP on mine & multiple other matters ( no actual court reference numbers though).

Do this mean my debt (CCJ) has now been transferred to the High Court?

    Hi Rileybaby


    It may simply be that RW have acquired a bulk load of debts from MKDP and are seeking to formally re-register the relevant judgments in their name.


    If your debt was for consumer credit of some sort (loan, credit cards, catalogues etc.) it can't normally be enforced through the High Court.


    Do tell us a bit more about the nature of the debt and any action already taken if you can.

    Hi,

    It was a credit card debt to Barclay card for £2,552 inc charges the CCJ relates back to March 2013.

    The debt was transferred to MDKP and as it stands I've not yet paid anything off it ( couldn't afford too)!only ended Up with it due to breakdown of marriage. Now I have had the letter saying that RW now own the debt.

    Do you need anything else off me?

    Ok,

    From what you say, all it means is your account has been bought out/transferred to Robinson way.

    As Dennis said, the High court don't normally deal with consumer type debts.

    Expect them to be in touch with you soon.

    You should be aware if you don't make some kind of payment to this account, they can enforce the debt by other methods, such as an attachment of earnings order, or even bailiffs attending your home address.

    I know it's like looking into a crystal ball, but can I make a nominal offer until such time I can pay the debt in full / make bigger payments??

    What level of payment did the court originally set ?


    Because if its too much, you can request a lower payment, that you can afford.

    I don't think they set any level of payment - although I'm not certain and have no idea how to find this out.

    Did you recieve court paperwork in the post, acknowledge it, file a defence, or anything like that ?

    If not, then we can assume a judgement by default must of been granted.
    You can contact the court concerned to find out the nitty gritty.
    I would assume it was Northampton bulk centre ?

    I didn't get any paper work about it ( not even the CCJ ) I'm not saying that it wasn't sent but I'm guessing my ex took the paperwork ( he took the post on a regular basis & whatever he wanted from the house until I got peed off & changed the locks) which obviously messed up lots of things and why I had no idea about the debt or the orders until it was too late!

    I'd give National Debtline a quick ring if I were you.

    They'll be able to advise you of your next move.

    You may have a case to get the judgment set aside, as you did not recieve the paperwork, best to get some expert advice on this.
