Creditor asking for payment

Hi I thought after I filed for bankruptcy in 2012 I could draw a line under a bad time and rebuild my life. Things were going great, the feeling of sickness I had before Sept 2012 was in the past. Then tonight I got home to a letter from a creditor wanting payment for a bill from 2008. That feeling in the pit of my stomach came back. I cant remember if I listed them on the bankruptcy form and im not sure if I didn't are they included in it? Can they still ask me to pay it if I didn't? xx

  • No they can't require you to pay

Call them and offer £0.00 with a final payment of £0.00

I did this with Barclaycard when they chased me post BR and the operative said something along the lines of this not being acceptable.
I replied it is when you are bankrupt.

They asked me to prove it and I said I could not affoard a stamp but they could look up my BR online if they wished at no cost to them

Don't worry- they are powerless :D

ALL unsecured debts are included within the bankruptcy - even if they aren't specifically listed on your bankruptcy SoA. So, that debt has been written off within your bankruptcy and cannot be chased as it no longer exists.

So don't pay them anything, and obviously don't sign any documents they send you.

    HTH :)

Thank you for putting my mind at rest. I thought that, but wasn't 100% sure. They have given me till 21st Jan to pay or they are applying to court to give me ccj. I will ring them in the morning. xx

    Ahah. I finally found it!

You can take great delight in sending them Fe.ck off letter #1 from this thread:

Hi, I have just spoke to a very hopeful member of Unicoms legal department, who when I gave her the ref number said " ah so you will be wanting to settle your account" when I said "er no I wont be making a payment at all" I went on to tell her why and she seemed to be stumped as what to say then. So I just told her the court, date, number and said if you have any questions contact the official receiver. The account is now closed. It felt great to be able to tell them to sod off. xx
