Can an employer dictate how you commute?

    Yes that's fair comment. But I might think that so far you get a warning. Next time you might not. Not even your GP can say it will always come with a warning. I honestly doubt, for all that he was at fault, that the bin driver thought something bad would happen. Nobody ever does. A friend of mine has been told by her GP that she can apply for her licence back now. That is after a brain hemorrhage that nearly killed her, and her consultant agrees she could get her licence back even though he also says she could have another at any time. It could happen. Or might not. She refused to apply for it back and isn't willing to dice with someone else's life. Yes, more serious perhaps than your situation. But she may also never be a risk again. According to doctors. So I'm not sure that they are really always all that good at advising us on what is best for us.

    Indeed.

    Just going through my contract, and it's a condition of my employment that I maintain a driving licence, so the confirmation from my own GP is important in that respect. Diagnosis is that it could just have been a short term thing, and potential triggers are:


    Fatigue
    Heat exposure
    Hunger (hypoglycemia)
    Severe pain
    Stress

    All of those are pretty manageable. GP has agreed with me on a specific symptom in there that is likely to be the cause though!

    DVLA have not been informed. According to their website, I should ask my doctor if the condition affects my driving, which my GP has said it doesn't.

    Possibly, but unlikely. This tends to be more the case when there is case law for lots of potential members / employees to be made. This is so unusual I can't imagine it would be of great interest as case law, and being a non-member, and with little potential to sell to other non-members - not a case I can see any unions willing to take.

    Well on the bright side, if you stay in the UK you aren't likely to get much heat exposure. beach holidays are possibly screwed up though!
  • How does he know how you got there? Does he ask to see the bus ticket as proof?

    Did you ask your line manager what they were asking of OH when the referral was made (were you informed and given a copy)?

    Management will likely have had case related questions for OH, you should have been offered an opportunity to see the subsequent report before it found its way to management, was this offered?

    I'm wondering if this is something you can raise as a grievance and effectively appeal?

    Did you ask to see the OH report before it was sent to your company? When I needed one, I did that, and was glad to have done so because there was one sentence I thought was very badly worded, giving a completely wrong impression! This was then corrected.

    I asked to see what they had requested from OH, but this information was never given to me. I did see the OH report prior to release, and requested amendments to the report due to inaccuracies, namely that they hadn't made any reference to the diagnosis from my GP, as well as having made errors relating to my address.

    OH were happy to say that all tests from my GP had been unremarkable, but had never approached them for information. They stated they would not amend the report without any medical history, but were happy to make the statements about not driving for work purposes. On the report they sent to my employer, they didn't even amend the address details they had got incorrect!

    I should also probably mention that, between the OH appointment and them receiving the report, I was told to stay off work by my employer and that it would not be counted as sick leave. I was fit for work during the period, and had been working fine on the day of the appointment itself. On my return to work however, the company reneged on this, and counted it as 2 weeks of sick leave, refusing to keep their word even with a fit note from my GP for the period in question.
