Yes Car Credit / Go Debt

Afternoon,

In May 2004 i took out an agreement with Yes Car Credit. Shortly after my circumstances changed and i arranged with Yes Car Credit to return the car (Apx 3-5 Months later), i was told verbally this was OK. Shortly after i received letters from Go Debt requesting payments, i had nothing in writing from yes Car Credit to say i was Ok to return the vehicle so they were requesting payments for the full amount of the agreement. I set up a monthly payment with Go-Debt which i am still paying to date.

I recently added this to a PPI claim pack but was unable to progress this any further as it was before the regulation kicked in in January 2005 and Yes Car Credit have off course ceased trading. I was told that i could not take out the agreement unless i had the PPI. As it stands i still owe around £1,500 does anyone know anyway around paying the remaining balance? I keep threatening go debt that i am not liable to pay the outstanding but they keep treating to take me to court for the outstanding if i do not keep up payments.

Any Help would be appricated.

    A valueable lesson learned, get everything in writing !!!

    You could make a CCA Request – Section 77 – 79
    Under these two sections of the Consumer Credit Act, it is your right to request a copy of the executed credit agreement from the creditor, along with specific and current information concerning the debt (s 77 relates to fixed-sum loan agreements, s 78 refers to running-account credit (credit cards) and s 79 to hire agreements).

    As the company has gone bust, they may have trouble providing it.

    Non compliance would make the debt unenforceable.

    Worth doing in my opinion.

  • I have previously requested the agreement from Go-Debt which they supplied, I'm not sure if it make any difference but on the day i took out the agreement it was only signed by me (I have a copy of this agreement i took away on the day) there was no signature for the section on behalf of Yes Car credit. The Agreement they supplied was signed but was signed a few weeks later?

    There's no requirement to provide a signature on an agreement, so that closes that avenue unfortunately.

    Threats of court action are common place from DCA's.
    Dosent mean they actually would, although it's possible.

    Your choices are, continue paying, or chance your arm there bluffing.

    A little research has revealed that provident, the parent company of yes car credit, are aggressively trying to recoup all the outstanding loans they had, there business practices were EXTREAMLY suspect to say the least.

    They have enlisted some dubious DCA's to pursue these accounts.
    Short of taking legal action yourself to challenge the validity of your credit agreement, I can't see what else you can do, unfortunately.

  • Hello, I also took a car with Yes Car Credit, I fell into difficulty and returned the car in less than 6 months, as was agreed, no more was to be paid. I was then, after a month or two, hit with a massive bill, well in excess of the original car cost by Direct Auto Finance who passed it on to Direct Legal Collections. I settled the outstanding balance 4 years ago, even though I thought I didn't owe it. I am still convinced I didn't owe it but I don't know where to go about aking for a refund. Also, I have tried twice, unsuccessfully to reclaim PPI as I know it was mis-sold, although, Provident insist they didn't mis-sell it, although, I know at the time, I specifically asked NOT to have PPI or GAP and was told that I had to for the agreement to commence, like so many other people. I have the original agreement. Has anyone had any success with YCC/DAF or DLC??
