Advice on dealing with DCA

I have a lot o debt - 100k and have released equity from my property 50k to try and get out of it
some creditors have accepted offers of 50%:)
a few issued default notices a couple of weeks ago and one has been passed to a dca. my question is about how to deal with them. i phoned this morning and they wanted me to pay half today and the remaining half next month. when i said that i had offered to pay half direct to creditor they said that they were now dealing with it. they offered a llower repayment to be paid over 3 months. when i said that this was higher than the min payment i had originally defaulted on they said tht they would send a claim form for me to do income and expenditure and that if i could oly pay 12.50 a month then this would be registered as a ccj
is all of this correct? i don't understand why they would want to go to court over a small amount? I did a budget with ccs and theyy said that this was all that i could afford to pay.
is there any room for negotiation at this point? who is my creditor? next or the new dca?
many thanks for further clarificatoion. i really am trying to avoid ccj but if i pay this in full then i can't pay the rest of my creditors.

They are probably trying it on. DCA will usually be more willing to accept lower amounts because they buy the debts off creditors a lot less.
Download the payment calculator off national debthelpline website and fill it in and there are also letters on there to offer payments, stand firm and they will give in!

Hi lililou - Nobody, not even a Debt Collection Agency can register a CCJ without first issuing a summons through the County Court. In the UNLIKELY event of this debt going to court, the judge would ask you, based on your soa, what you can afford to pay. It is unlikely that you would be asked to pay any more than you could afford and any such payment order would be just as binding on Lewis as it is on you.
I think that you should have a chat with CAB or CCCS on this one.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
